A Person Makes His Slave a Mukatab

٢٣٥٨١ - حدثنا ابو بكر قال: حدثنا ابو بكر بن عياش عن مغيرة عن إبراهيم قال: إذا كاتب عبده وله عبد او امة فهو من مكاتبته، وإن كان له ولد قد كتمهم فليس (له) (١) ذلك.

Ibrahim says that when a person makes his slave a mukatab (contracted for freedom) and he has other male and female slaves as well, then they will be included in his mukatabat (contract). And if he has children and he hides them, then there is nothing upon him.

It is narrated from Ibrahim in the same manner.

٢٣٥٨٣ - حدثنا ابو بكر قال: حدثنا محمد بن (بكر) (١) عن ابن جريج عن عطاء قال: قلت له: (رجل) (٢) كاتب عبدا له او قاطعه فكتمه (مالا) (٣) له: رقيقا او عينا او مالا (٤) غير ذلك، قال: هو للعبد.

(٣) في [أ، ح، ز، ط]: (مال).
(٤) في [ز]: زيادة (له).
Hazrat Ibn Jurayj says that I asked Hazrat Ata: A person made his slave a mukatab (contracted for freedom), and the slave hid his wealth. So, to whom will the slave, or the property, or the wealth, etc., belong? He replied: It will belong to the slave.

Hasan says that the umm walad and all her children will be included in the mukatabah.
