٢٤٣٤٦ - حدثنا ابو بكر قال: حدثنا (وكيع قال: حدثنا) (١) سفيان عن عبيدة ⦗٤٨١⦘ (بن) (٢) ابي صالح عن الشعبي قال: من كفل عن رجل بكفالة ولم يامره بها فاداها عنه فليس للمكفول عنه شيء، إنما هي حمالة تحملها.

(١) سقط ما بين القوسين من [هـ].
(٢) في [هـ، ح، ط]: (عن).
Hazrat Sha'bi (may Allah have mercy on him) says that if a person becomes a guarantor without permission or order and makes the payment on behalf of the guaranteed person, then nothing is obligatory upon the guaranteed person. It is the guarantor who has taken upon himself the burden that he has assumed.
