A Person Buys Fodder by Weight but Takes Possession Without Weighing

٢٤٥٦٠ - حدثنا ابو بكر قال: حدثنا معاذ بن معاذ عن اشعث عن الحسن في رجل اشترى علفا بوزن فقبضه بغير وزن فتلف العلف، (فقال) (١): هو من مال الذي اشتراه.

(١) في [جـ، أ، ح]: (قال).
Hasan says regarding the person who buys fodder by weight, and takes possession of it without weighing, then the fodder is destroyed, he said: its destruction will be counted from the buyer's wealth. The same is narrated from Muhammad, may Allah have mercy on him.
