٢٤٨٧٨ - حدثنا ابو بكر قال: حدثنا وكيع قال: حدثنا زياد (بن ابي زياد) (١) قال: اشتريت من رجل شاة فنقدته ثمنها، ثم جئت لاقبضها فقال البائع: إنها ارادت ان تموت فذبحها اهلي، (فخاصمته) (٢) إلى شريح فقال شريح: رد عليه الثمن.

Hazrat Ziyad bin Abu Ziyad narrates that I bought a goat from a person and paid the price. Then, when I came to take possession of it, the seller said that the goat was about to die, so I slaughtered it. I took the dispute to Hazrat Shurayh. Hazrat Shurayh said: Return the price for it.

٢٤٨٧٩ - حدثنا ابو بكر قال: حدثنا وكيع قال: حدثنا زكريا عن عامر انه سئل عن رجل اشترى عبدا فقال المشتري للبائع: (بعه) (١) لي، فهو منك انفق (٢)، فمات العبد في يد البائع، فقال: يغرم البائع ثمنه.
ريفرينس و تحكيم الحدیث:
(١) في [ز]: (به).
(٢) أي: أنه يسهل عليك بيعه وترويجه أكثر مني.
Hazrat Amir was asked about a person who bought a slave, then the buyer said to the seller, "Sell him for me, he is more destitute than you." The slave died while in the seller's possession. He replied: The seller will be liable for its price.

٢٤٨٨٠ - حدثنا ابو بكر قال: حدثنا وكيع قال: حدثنا سفيان عن منصور عن إبراهيم قال: (إذا) (١) (اعتقب) (٢) البائع البيع ببعض الثمن، فمات فهو من مال البائع.
ريفرينس و تحكيم الحدیث:
(١) سقط من: [أ، هـ].
(٢) في [ح، هـ]: (اعتقت)، والمراد: أنه اشترط أن يبقى بعض الثمن بعد تسليم المبيع.
Ibrahim says that if the seller withholds the sold item with himself in order to receive the price, and it is destroyed, then it will be counted as the seller's property.
