الرجل يطالب فيموت
If a Debtor Dies While Owing a Debt

٢٤٨٩٩ - حدثنا ابو بكر قال: حدثنا عبد الاعلى عن داود عن عامر عن شريح في رجل كان يطالب رجلا (١) بدين، فمات المطلوب فقال شريح: بينته على اصل ⦗٨٤⦘ حقه، والبراءة على اهل المتوفى ان (صاحبهم) (٢) قد برئ، او يمين الطالب انه مات يوم مات والحق عليه.
ريفرينس و تحكيم الحدیث:
(١) في [ط]: زيادة (به).
(٢) في [ح، ز]: (صاحبتهم).
Hazrat Shurayh says regarding the person from whom someone demands his right, and then the demanded person passes away, that his testimony is upon the original right, and the acquittal is upon the heirs of the deceased that their companion had been acquitted. Or else, the claimant should swear an oath that the deceased passed away while his right was still due upon him.
