Blood Money for a Broken Hand or Foot That Heals

٢٨٨٦٧ - حدثنا ابو بكر قال: حدثنا جرير عن منصور عن إبراهيم قال: كان يقال: إذا كسرت اليد او الرجل ثم برات ولم ينقص منها شيء ارشها مائة وثمانون درهما.
Ibrahim said that it was said: When a hand or foot is broken and then heals again without any defect arising in it, then the compensation (diyah) for it is "180" dirhams.

٢٨٨٦٨ - حدثنا ابو بكر قال: حدثنا وكيع عن سفيان عن القعقاع (بن) (١) يزيد عن إبراهيم: في اليد او الرجل إذا كسرت صلح.

It is narrated from Ibrahim that when the hands and feet are cut off, reconciliation is permissible in this matter.

٢٨٨٦٩ - حدثنا ابو بكر قال: حدثنا عبد الرحيم عن اشعث عن عبد الله بن ذكوان ان عمر قضى في الرجل كسرت ساقه فجبرت واستقامت فقضى فيها بعشرين ⦗٩٥⦘ دينارا، قال: قيل له إنها وهنت (١) (٢).
ريفرينس و تحكيم الحدیث:
(١) أي: أن السبب في حكم عمر بهذا أنه قيل له: إن الرجل ضعفت بسبب الكسر.
(٢) منقطع؛ عبد اللَّه بن ذكوان لا يروي عن عمر، وأشعث ضعيف.
It is narrated from Hazrat Abdullah bin Zakwān that Hazrat Umar gave a verdict regarding a man whose shinbone was broken and then healed properly, that the compensation is twenty dinars. Abdullah bin Zakwān stated that it was said to him, "This is a very light compensation."

٢٨٨٧٠ - حدثنا ابو بكر قال: حدثنا وكيع حدثنا سعيد بن عبد الرحمن (عن ابن سيرين) (١) عن شريح في رجل كسر يد رجل فجبرت، فقال: شريح على الكاسر اجر الجابر، اما يحمد الله حيث رد عليه يده.

Hazrat Shurayh, regarding a person who broke another's hand and then it healed, has stated that the one who broke it is only liable for the fee of the one who set the bone. Should not the one whose hand was broken be grateful that Allah healed his hand?

٢٨٨٧١ - حدثنا ابو بكر قال: حدثنا وكيع قال: حدثنا شعبة عن ابي بشر عن سعيد بن المسيب قال: في الاعضاء كلها حكومة.
Hazrat Saeed bin Musayyib said that there is judgment in all the organs.

٢٨٨٧٢ - حدثنا ابو بكر قال: حدثنا يزيد بن هارون عن (ابن) (١) سالم عن الشعبي عن زيد بن ثابت: في الساق تكسر خمسون دينارا، وإذا (برات) (٢) على (عثم) (٣) ففيها خمسون دينارا وفي العثم ما فيه (٤).

(٢) في [ك]: (برت).
(٣) في [ط]: (عثيم).
(٤) ضعيف جدًا؛ محمد بن سالم متروك.
It is narrated from Hazrat Zaid bin Thabit that when the shin bone is broken, there are fifty dinars (as compensation) for it, and when it heals crooked, there are fifty dinars for it, and for the crookedness, the same compensation applies as for the breaking.

٢٨٨٧٣ - حدثنا ابو بكر قال: حدثنا عبد الوهاب بن عطاء عن سعيد عن قتادة عن سليمان بن يسار قال: في الذراع والساق والعضد والفخذ إذا كسرت ثم جبرت قلوصان قلوصان.
Sulaiman Yasaar says that when the wrist, shin, arm, or thigh is broken and then heals, the compensation (diyah) for each is two young she-camels.

٢٨٨٧٤ - حدثنا ابو بكر قال: حدثنا محمد بن بكر عن ابن جريج عن عطاء ⦗٩٦⦘ (قلت) (١) له: كسر اليد او الرجل (او) (٢) (الترقوة) (٣) فجبرت (فاستوت) (٤)، قال: في ذلك شيء، وما بلغني ما هو؟.

(٣) في [ب، م]: (الرقوة)، وفي [ط]: (الرقرة).
(٤) في [ط]: (فاستوصل).
Hazrat Ibn Jurayj narrates from Ata that I asked him, "If a hand or foot or collarbone breaks and then heals crooked, what is the ruling?" He replied, "There is some compensation for it, but the exact amount or nature of it has not reached me."

٢٨٨٧٥ - حدثنا ابو بكر قال: حدثنا ابو داود الطيالسي عن ابي حرة عن الحسن في رجل كسرت يده قال: يعوض من يده.
It is narrated from Hasan regarding the person whose hand has been broken that he will be given retaliation for his hand. Hasan states that Muhammad said that Shurayh said that he will be given the fee for the physician.
