If Someone Breaks Another's Tooth

٢٨٨٨٨ - حدثنا ابو بكر قال: حدثنا ابو خالد الاحمر عن حميد عن انس ان النبي ﷺ (١) امر بالقصاص في سن وقال:"كتاب الله القصاص" (٢).

(٢) حسن؛ أبو خالد صدوق، أخرجه البخاري (٤٢٢٩)، ومسلم (١٦٧٥).
It is narrated from Hazrat Anas that the Messenger of Allah, peace and blessings be upon him, gave the ruling of retribution (qisas) in the case of a tooth and said, "The Book of Allah..." meaning that it is the retribution ordained by Allah.

٢٨٨٨٩ - حدثنا ابو بكر قال: حدثنا وكيع قال: حدثنا سفيان عن ازهر عن محارب بن دثار قال: جاء رجلان إلى شريح قد كسر هذا ضرس هذا، وهذا ضرس هذا قال: هذه (ثنية) (١) بضرس قوما.

Hazrat Muharib bin Dithar narrates that two men came to Shurayh; one had knocked out the other's molar tooth, and the other had done the same to the first. So he (Shurayh) said: "This tooth is in exchange for the molar, so both of you may go."

٢٨٨٩٠ - حدثنا ابو بكر قال: حدثنا حفص عن اشعث عن الشعبي والحسن قالا: ليس في (العظام) (١) قصاص ما خلا السن او الراس.

Hazrat Sha'bi and Hasan have stated that there is no qisas (retaliation) for the head or teeth in any bone.

٢٨٨٩١ - حدثنا ابو بكر قال: حدثنا وكيع عن إسرائيل عن جابر عن عامر قال: يقاد من السن.
Hazrat Amir said that retaliation (qisas) will be taken for a tooth.

٢٨٨٩٢ - حدثنا ابو بكر قال: حدثنا محمد بن بكر عن ابن جريج قال: قلت لعطاء: العين يقاد منها؟ قال: نعم، والسن.
Hazrat Ibn Jurayj said that I asked Ata whether retribution (qisas) would be taken for the eye, and he replied, "Yes, and retribution will also be taken for the tooth."
