ما قالوا: إذا أخذ على سرقة (يقطع) أو لا؟
Those Who Say: If a Slave Is Caught Stealing, Is His Hand Cut or Not?

٣٠٠٥٣ - حدثنا ابو بكر قال: حدثنا (هشيم) (١) عن ابي بشر عن يوسف (بن ماهك) (٢) ان عبدا لبعض اهل مكة سرق رداء لصفوان بن امية، فاتي به النبي ﷺ فامر بقطعه، فقال: يا رسول الله! تقطعه من اجل ثوبي؟ قال:"فهلا (قبل ان تاتيني) (٣) (به)" (٤) (٥).

Hazrat Yusuf bin Mahak narrates that a slave of someone from among the people of Makkah stole the sheet of Hazrat Safwan bin Umayyah. He was brought to the Prophet Muhammad (peace and blessings be upon him), and the Prophet (peace and blessings be upon him) ordered his hand to be cut off. Upon this, Hazrat Safwan said: O Messenger of Allah (peace and blessings be upon him)! Will you cut off his hand because of my garment? The Prophet (peace and blessings be upon him) said: Why did you not think of this before bringing him to me?

٣٠٠٥٤ - حدثنا ابو بكر قال: حدثنا عبد الرحيم بن سليمان عن عبد الملك بن ابي سليمان عن عطاء في العبد يسرق، قال: يقطع.
Hazrat Abdul Malik bin Abi Sulaiman narrates that it is reported from Hazrat Ata regarding a slave who commits theft. He said: His hand should be cut off.

٣٠٠٥٥ - حدثنا ابو بكر قال: حدثنا محمد بن بكر عن ابن جريج قال: اخبرني ابو بكر بن عبد الله عن ابي الزناد انه اخبره ان (عبد الله بن عامر) (١) اخبره ان ابا بكر قطع يد عبد سرق (٢).

Hazrat Abdullah bin Aamir narrates that Hazrat Abu Bakr cut off the hand of a slave who had committed theft.
