Regarding Betrayal: What Punishment Should Be Applied?

٣٠٥٧٦ - حدثنا ابو بكر قال: حدثنا الضحاك بن مخلد عن ابن جريج عن ابي الزبير عن جابر قال: قال رسول الله ﷺ:"ليس على الخائن قطع" (١).
ريفرينس و تحكيم الحدیث:
(١) رجاله ثقات، وتقدم تخريجه برقم [٣٠٥٦٩].
Hazrat Jabir narrates that the Messenger of Allah (peace and blessings be upon him) said: The punishment of amputation will not be carried out on the one who commits treachery.

٣٠٥٧٧ - حدثنا ابو بكر قال: حدثنا حفص عن اشعث عن ابي الزبير عن جابر قال: ليس على الخائن قطع (١).
ريفرينس و تحكيم الحدیث:
(١) ضعيف؛ لضعف أشعث، وأخرجه النسائي ٨/ ٨٩، وورد مرفوعًا كما في الذي قبله، وتقدم موقوفًا برقم [٣٠٥٦٨].
Hazrat Abu Zubair narrates that Hazrat Jabir said: The punishment of cutting (the hand) will not be carried out on the one who commits treachery.

٣٠٥٧٨ - حدثنا ابو بكر قال: حدثنا ابو خالد عن اشعث عن الشعبي قال: جاء رجل إلى شريح فقال: إن هذا سرق مني، قال: ومن هذا؟ قال: اجيري، قال: ليس بسارق من ائتمنته على بيتك.
Hazrat Sha'bi narrates that a man came to Hazrat Shurayh and said: "Indeed, this person has stolen from me." Hazrat Shurayh asked: "Who is this person?" He replied: "He is my servant." Hazrat Shurayh said: "That person cannot be considered a thief whom you have appointed as a trustee in your house."

Hazrat Ibn Jurayj states that Hazrat Ata said: The punishment of amputation will not be enforced in the case of betrayal.

٣٠٥٨٠ - حدثنا ابو بكر (١) قال: حدثنا ابو داود الطيالسي عن ابي حرة عن الحسن في غلام كان مع قوم في السوق، فسرق بعض متاعهم فقال: هو خائن ولا قطع عليه.

(١) زيادة في [ط]: (قال: حدثنا شريك).
Hazrat Abu Hurrah narrates that it is reported from Hasan Basri regarding a slave who was in the market with some people and stole some of their goods. He said: He is a betrayer, and the punishment of cutting (the hand) will not be carried out on him.
