Regarding the Man and Woman Who Both Confess to Hudud and Then Retract

٣٠٧٥١ - حدثنا ابو بكر قال: حدثنا حفص بن غياث عن حجاج عن الحسن بن سعد عن عبد الله بن شداد ان امراة رفعت إلى عمر اقرت بالزنا اربع مرات، فقال: إن رجعت لم نقم عليك، فقالت: لا يجتمع علي امران آتي بالفاحشة ولا يقام علي الحد قال: فاقامه عليها (١).

(١) منقطع؛ حكمًا، حجاج مدلس.
Hazrat Abdullah bin Shaddad narrates that a woman was brought before Hazrat Umar who confessed to adultery four times. Upon this, he said: If you retract, we will not enforce the prescribed punishment upon you. The woman replied: Then two matters will be combined against me! I have committed an immoral act and the prescribed punishment has not been enforced upon me. So he enforced the prescribed punishment upon her.

٣٠٧٥٢ - حدثنا ابو بكر قال: حدثنا حفص عن حجاج عن (نافع عن) (١) سليمان بن يسار ان ابا واقد بعثه عمر إليها -فذكر مثله (٢).

(٢) منقطع؛ سليمان بن يسار لم يسمع من عمر.
Hazrat Sulayman bin Yasar narrates that Hazrat Abu Waqid was sent by Hazrat Umar to that woman, then he mentioned the hadith similar to the previous one.

٣٠٧٥٣ - حدثنا ابو بكر قال: حدثنا وكيع عن إسرائيل عن جابر عن عامر وعطاء قالا: إذا اقر بحد زنا او سرقة ثم جحد درئ عنه (الحد) (١).

Hazrat Jabir narrates that Hazrat Amir Sha'bi and Hazrat Ata, both of these personalities, stated: When someone confesses to the hadd punishment for adultery or the hadd punishment for theft, and then retracts the confession, the punishment will be waived.

٣٠٧٥٤ - حدثنا ابو بكر قال: حدثنا ابن مبارك عن حماد بن سلمة عن قتادة عن يحيى بن يعمر قال: إن كان قد اقر فقد انكر، يعني: الذي يقر بالحد، ثم يرجع.
Hazrat Qatadah states that Hazrat Yahya bin Ya’mur said: If someone confesses and then denies—that is, a person who admits to the prescribed punishment and then retracts.

٣٠٧٥٥ - حدثنا ابو بكر قال: حدثنا زيد بن الحباب عن حماد بن سلمة عن حميد عن الحسن في الرجل يقر (عند) (١) الناس ثم يجحد، قال: يؤخذ به.

Hazrat Humaid narrates that it is reported from Hasan Basri regarding the person who confesses before people and then denies it, he said: He will be apprehended because of this.

٣٠٧٥٦ - حدثنا ابو بكر قال: حدثنا محمد بن ابي عدي عن اشعث عن الحسن في الرجل يقر بالحد دون السلطان ثم يجحد إذا رفع: لم ير ان يلزمه.
Hazrat Ash'ath narrates that it is reported from Hasan Basri regarding the person who confesses to a hadd punishment in the absence of the ruler, then denies it when he is presented (before the ruler). So he (Hasan Basri) did not hold the opinion that it should be made obligatory upon him.

٣٠٧٥٧ - حدثنا ابو بكر قال: حدثنا محمد بن بكر عن ابن جريج قال: اخبرني إسماعيل عن ابن شهاب قال: من اعترف مرارا كثيرة بسرقة او بحد ثم انكر: لم (يجز) (١) (عليه شيء) (٢).

Ismail narrates that Hazrat Ibn Shihab said: If a person confesses to theft or a hadd punishment several times and then denies it, nothing will be enforced upon him.
