A Man Divorced His Wife Then Accused Her: What Punishment Is Applied?

٣٠٧٧٥ - حدثنا ابو بكر قال: حدثنا زيد بن الحباب عن ابي عوانة عن ابي بشر عن عمرو بن هرم عن جابر بن زيد عن ابن عباس في رجل طلق امراته واحدة ثم قذفها قال: يجلد الحد ليس كمن لم يطلق (١).

(١) صحيح.
Hazrat Jabir bin Zaid narrates that it is reported from Hazrat Ibn Abbas (may Allah be pleased with them) regarding a man who gave his wife one divorce and then accused her; he said: The punishment of false accusation (hadd-e-qazf) will be imposed on him. It will not be as if he had not divorced her. And Hazrat Ibn Umar (may Allah be pleased with them) said: He can perform li'an (mutual cursing) as long as he has the right to take her back.

30776 - Ibn (Umar) (1) said: He performs li'an (2) if he has the right of return (3).

٣٠٧٧٧ - حدثنا ابو بكر قال: حدثنا ابن علية عن يونس عن الحسن قال: إذا طلق الرجل امراته ثلاثا ثم قذفها قال: يجلد الحد، إلا ان تكون حاملا فإن (كانت) (١) حاملا لاعنها.

Yunus narrates that Hasan Basri said: When a man gives his wife three divorces and then accuses her (of adultery), the punishment for false accusation (hadd-e-qazf) will be imposed on that man, unless she is pregnant. So if she is pregnant, then he will perform li'an (mutual cursing) with her.

٣٠٧٧٨ - حدثنا ابو بكر قال: حدثنا جرير عن منصور عن الحكم في رجل طلق امراته ثلاثا وهي حبلى، ثم انتفى (مما) (١) في بطنها قال: يجلد، ويلزق به الولد.

Hazrat Mansur narrates that it is reported from Hazrat Hakam regarding a man who gave his wife three divorces while she was pregnant, then he also denied the child in her womb. He (Hakam) said: He will be flogged and the child will be attributed to him.

٣٠٧٧٩ - حدثنا ابو بكر قال: حدثنا جرير عن مغيرة عن إبراهيم قال: إذا طلق ثلاثا ثم انتفى من ولده وهو لا يملك الرجعة (جلد) (١) والزق به الولد، وإذا انتفى من ولده وهو يملك الرجعة لاعن ونفي عنه الولد، وإن كان (لم) (٢) (يقر به) (٣) قط.

Hazrat Mughira narrates that Ibrahim said: When a man gives his wife three divorces and then denies his child while he no longer has the right to take her back, he will be flogged and the child will be attributed to him. And when he denies his child while he still has the right to take her back, he will perform li'an (mutual cursing) and the child will be disassociated from him, even if he never acknowledged the child.

٣٠٧٨٠ - حدثنا ابو بكر قال: حدثنا ابن إدريس عن الشيباني عن الشعبي في رجل طلق امراته طلاقا بائنا، فادعت حملا (فانتفى) (١) منه (قال) (٢): يلاعنها.

Hazrat Shaibani states that it is narrated from Hazrat Sha’bi regarding a man who gave his wife an irrevocable divorce. Then the woman claimed to be pregnant, but the man denied the child. He (Sha’bi) said: He will perform li’an with her.

٣٠٧٨١ - حدثنا ابو بكر قال: حدثنا (هشيم) (١) عن مغيرة عن الشعبي انه ⦗٨⦘ سئل عن (رجل) (٢) طلق امراته ثلاثا فجاءت (٣) بحمل فانتفى منه، قال: فقال: يلاعن، قال: فقال الحارث: يا ابا عمرو، إن الله قال في كتابه: ﴿والذين يرمون ازواجهم﴾ [النور: ٦]، افتراها له زوجة؟ قال (٤): فقال الشعبي: إني لاستحي إذا رايت الحق الا (ارجع) (٥) إليه.

Hazrat Mughira narrates that Hazrat Shabi was asked about a man who had given his wife three divorces. Then she came while pregnant and denied the pregnancy. He replied: He will perform li'an (mutual cursing). The narrator says that Hazrat Harith said: O Abu Umar! Indeed, Allah, the Lord of Honor, has stated in His Book: Those who accuse their wives... Did he accuse his wife? Upon this, Hazrat Shabi said: Indeed, I feel shy that when I recognize the truth, I do not turn towards it.

٣٠٧٨٢ - حدثنا ابو بكر قال: حدثنا عباد عن الشيباني عن الحكم وحماد عن إبراهيم: في الرجل يطلق امراته طلاقا بائنا ثم يقذفها، قال: يضرب.
Hazrat Hakam and Hazrat Hammad state that it is narrated from Ibrahim regarding the man who gave his wife an irrevocable divorce and then accused her: He (Ibrahim) said, "He will be flogged."

٣٠٧٨٣ - حدثنا ابو بكر قال: حدثنا عثمان بن عثمان القرشي عن عثمان (البتي) (١) قال: كان القاسم بن محمد يقول في رجل طلق امراته ثم قال لها: زنيت وانت امراتي، قال: يلاعن.

Hazrat Usman Bati narrates that Hazrat Qasim bin Muhammad used to say about a man who had divorced his wife, then said to her: "You committed adultery while you were my wife." He (Qasim bin Muhammad) said: He will perform li'an (mutual cursing).
