Regarding the Person Who Says to His Wife: I Saw You Commit Zina Before Marrying You

٣٠٧٧٢ - حدثنا ابو بكر قال: حدثنا عبدة بن سليمان عن سعيد عن قتادة عن سعيد بن المسيب في رجل قال لامراته: رايتك تزنين قبل ان (تكوني) (١) عندي، قال سعيد: حد ولا ملاعنة.

Hazrat Qatadah narrates that it is reported from Hazrat Saeed bin Musayyib regarding a man who said to his wife: "I saw you committing adultery before you came to me." Hazrat Saeed said: The punishment of qazf (false accusation of adultery) will be imposed on him and there will be no li'an (mutual cursing). And Hasan Basri said: Neither the punishment of qazf will be imposed nor li'an will take place, because he said this to the woman at a time when she was already with him.

٣٠٧٧٣ - وقال الحسن: لا حد ولا ملاعنة؛ لانه قال لها ذلك وهي عنده.
30773 - Al-Hasan said: There is neither hadd nor li'an; because he said that to her while she was with him.

٣٠٧٧٤ - حدثنا ابو بكر قال: حدثنا ابن مبارك عن ابن جريج عن عطاء في رجل قال: لامراته زنيت وانت امة؟ قال: يحد.
Hazrat Ibn Jurayj states that it is narrated from Hazrat Ata regarding a man who said to his wife: "You committed adultery while you were a slave-girl." He (Hazrat Ata) said: The prescribed punishment (hadd) will be carried out on her.
