How Much of His Wealth May a Person Bequeath?

٣٢٩٦٠ - حدثنا ابن عيينة عن الزهري عن عامر بن سعد عن ابيه انه قال: مرض مرضا اشفى منه، فاتاه النبي ﷺ يعوده، فقال: يا رسول الله، إن لي مالا كثيرا وليس يرثني إلا ابنة (لي) (١) افاتصدق بالثلثين؟ قال:"لا"، قال: ⦗٢١٤⦘ (الشطر؟) (٢) قال:"لا"، (قلت) (٣): فالثلث؟ (قال:"الثلث، (والثلث)) (٤) (٥) كثير" (٦).

Aamir bin Sa’d narrates that Hazrat Sa’d bin Abi Waqqas (may Allah be pleased with him) said: Once I became so ill that I was near death. The Prophet Muhammad (peace and blessings be upon him) came to visit me, so I said,“O Messenger of Allah (peace be upon him)! I have a lot of wealth and my only heir is my one daughter. Can I give two-thirds of my wealth in charity?”He said,“No!”I said,“Then can I give half of my wealth in charity?”He said,“No!”I said,“And one-third?”He said,“One-third is much.”

٣٢٩٦١ - حدثنا وكيع عن هشام عن ابيه عن ابن عباس قال: وددت ان الناس غضوا من الثلث إلى الربع؛ لان رسول الله ﷺ قال:"الثلث كثير" (١).
ريفرينس و تحكيم الحدیث:
(١) صحيح؛ أخرجه البخاري (٢٧٤٣)، ومسلم (١٦٢٩).
Urwah narrates that Hazrat Ibn Abbas (may Allah be pleased with them) said that people began to make bequests of less than one third, making it one fourth of their wealth, because the Messenger of Allah (peace and blessings be upon him) had said: "One third is much."

٣٢٩٦٢ - حدثنا وكيع عن هشام عن ابيه ان الزبير اوصى بثلثه (١).
ريفرينس و تحكيم الحدیث:
(١) صحيح.
Urwah narrates that Hazrat Zubair (may Allah be pleased with him) made a will for one third of his wealth.

٣٢٩٦٣ - حدثنا ابو اسامة عن عبيد الله عن نافع عن ابن عمر قال: ذكر عند عمر الثلث في الوصية، (فقال) (١): الثلث وسط، لا بخس ولا شطط (٢).
ريفرينس و تحكيم الحدیث:
(١) في [أ، ح، ط، هـ]: (قال).
(٢) صحيح.
It is narrated from Nafi‘ that Hazrat Ibn ‘Umar (may Allah be pleased with them) said that when the mention of bequeathing one third of wealth was brought before Hazrat ‘Umar (may Allah be pleased with him), he said: One third is a moderate amount. It is neither too little nor too much.

٣٢٩٦٤ - حدثنا عبد الاعلى عن برد عن مكحول ان معاذ بن جبل قال: إن الله تصدق عليكم بثلث اموالكم زيادة في حياتكم -يعني الوصية (١).
ريفرينس و تحكيم الحدیث:
(١) حسن؛ برد صدوق.
It is narrated from Mak'hool that Hazrat Mu'adh bin Jabal (may Allah be pleased with him) said: Allah Almighty has granted you an increase in your life by giving you one third of your wealth, and by this he meant the bequest (wasiyyah).

٣٢٩٦٥ - حدثنا ابو معاوية عن جعفر بن برقان عن خالد بن ابي عزة قال: قال ابو بكر: (آخذ) (١) من (مالي) (٢) ما اخذ الله، من الفيء ⦗٢١٥⦘ فاوصى بالخمس (٣).
ريفرينس و تحكيم الحدیث:
(١) في [ط، هـ]: (آخر).
(٢) في [هـ]: (قال).
(٣) مجهول؛ لجهالة خالد بن أبي عزة، أخرجه مسدد كما في المطالب (١٥٢٩)، وابن عساكر ٣٠/ ٤٢٣.
Khalid bin Abi Azza narrates that Hazrat Abu Bakr said: I take from my wealth as much as Allah Almighty has taken from the wealth of fai, after that he made a bequest of one-fifth of his wealth.

٣٢٩٦٦ - حدثنا ابو معاوية عن جويبر عن الضحاك قال: اوصى ابو بكر وعلي بالخمس (١).
ريفرينس و تحكيم الحدیث:
(١) ضعيف منقطع، جويبر متروك، والضحاك لم يدرك أبا بكر.
Dhahhak states that Hazrat Abu Bakr (may Allah be pleased with him) and Ali (may Allah be pleased with him) had made a bequest of one-fifth of their wealth.

٣٢٩٦٧ - حدثنا ابن علية عن حميد (١) عن بكر (٢) (ان) (٣) (حميد) (٤) بن عبد الرحمن قال: ما كنت (لاقبل) (٥) وصية رجل يوصي بالثلث وله ولد.

(٢) في حاشية [جـ]: (هو بكر بن عبد اللَّه المزني).
(٣) في [أ، ب] (عن)، وفي [م]: (قال).
(٤) في حاشية [جـ]: (هو حميد بن عبد الرحمن البصري الفقيه العالم الثقة)، ولعل هذه التعليقات بخط العيني.
(٥) في [أ، ب]: (أقبل).
Bakr narrates that Hazrat Humaid bin Abdur Rahman said: I do not accept the will of a person who has made a bequest of one-third of his wealth while having children.

٣٢٩٦٨ - حدثنا ابو خالد عن هشام عن محمد عن شريح قال: الثلث (جهد) (١) وهو جائز.

Muhammad narrates that Hazrat Shurayh said that one third of the wealth is very excellent and its bequest is permissible.

٣٢٩٦٩ - حدثنا ابو اسامة عن (بشير) (١) بن عقبة عن يزيد بن الشخير قال: كان مطرف يرى الخمس في الوصية (حسنا) (٢).

Yazid bin Shakhir narrates that Hazrat Mutarrif considered the bequest of one-fifth of wealth to be good.
