When the Deceased Leaves a Nephew and a Grandfather

٣٣٣٣٦ - (١) حدثنا ابن فضيل عن بسام عن فضيل عن إبراهيم في رجل ترك جده، واخاه لابيه، وامه واخاه لابيه، فللجد النصف، ولاخيه لابيه وامه النصف في قول علي وعبد الله، وكان زيد يعطي الجد الثلث والاخ من الاب والام الثلثين، قاسم بالاخ من الاب مع الاخ من الاب والام ولا يرث شيئا (٢).

(٢) منقطع؛ إبراهيم لم يدرك هؤلاء الصحابة.
Ibrahim says regarding the man who dies leaving his grandfather, full brother, and paternal half-brother: the grandfather will receive half of the estate, and the full brother will receive the other half. This is the opinion of Ali (may Allah be pleased with him) and Abdullah (may Allah be pleased with him). Zaid (may Allah be pleased with him) used to give the grandfather one third of the estate and the full brother two thirds. In the division, he included the paternal half-brother with the full brother, but did not make the paternal half-brother an heir.

٣٣٣٣٧ - حدثنا وكيع قال: ثنا سفيان عن الاعمش عن إبراهيم قال: كان عبد الله يقاسم بالجد الإخوة إلى الثلث، ويعطي كل صاحب فرض فريضته، ولا يورث الإخوة من الام مع الجد، (ولا يقاسم) (١) (بالإخوة) (٢) للاب الإخوة للاب والام (مع الجد) (٣)، وإذا كانت اخت لاب وام (واخت) (٤) لاب وجد اعطى الاخت من الاب والام النصف والجد النصف، وكان علي يقاسم بالجد الإخوة إلى السدس، ويعطي كل صاحب فريضة فريضته، ولا يورث الإخوة من الام مع الجد، ⦗٣٠١⦘ (ولا يقاسم بالإخوة للاب الإخوة للاب والام) (٥)، ولا يزيد الجد مع الولد (على) (٦) السدس إلا ان لا يكون غيره، فإذا كانت اخت لاب وام واخ لاب وجد اعطى الاخت النصف، وجعل النصف بين الجد والاخ، وكان زيد يقاسم بالجد الإخوة والاخوات إلى الثلث، فإذا بلغ الثلث اعطاه الثلث، وكان للإخوة والاخوات ما بقي، ولا يورث الإخوة من الام مع الجد ولا يقاسم بهم، وكان يقاسم الإخوة للاب الإخوة للاب والام ولا يورثهم شيئا، وإذا كانت اخت لاب وام واخ واخت لاب، وجد اعطى الاخت من الاب والام النصف، وقاسم الاخ والاخت الجد (٧).

Ibrahim says that Abdullah (may Allah be pleased with him) used to include the grandfather with the brothers in the division of wealth, and used to give every rightful person his due, and would not make the maternal brother an heir in the presence of the grandfather, and in the case of the participation of full brothers with the grandfather in the division, he would not give the paternal brother a share in the division, and when a full sister, a paternal sister, and the grandfather were together, he would give half the wealth to the full sister and half to the grandfather. And Ali (may Allah be pleased with him) used to include the grandfather with the brothers in the division of wealth up to one-sixth, and would give every rightful person his due, and would not make the maternal brother an heir in the presence of the grandfather, and in the presence of children, would not give the grandfather more than one-sixth of the wealth, except if there was no other heir besides the grandfather. So when a full sister, a paternal brother and sister, and the grandfather were together, he would give half the wealth to the full sister and include the brother and sister with the grandfather in the division. Abu Bakr says that this issue will be resolved in two ways according to the statements of Ali (may Allah be pleased with him) and Abdullah (may Allah be pleased with him), and in three ways according to the statement of Zaid (may Allah be pleased with him).

33338 - Abu Bakr said: So this, according to the statement of Ali and Abdullah, is from two shares, and according to the statement of Zayd, from three shares.
