Regarding a Man Who Leaves a Grandfather, a Full Brother, and a Paternal Brother

٣٣٣٣٩ - حدثنا ابن علية عن خالد عن محمد بن سيرين قال: اراد عبيد الله بن زياد ان يورث الاخت من الام مع الجد، وقال: إن عمر قد ورث الاخت معه، فقال (عبد) (١) الله بن عتبة: إني لست بسبائي ولا حروري (فاقتف) (٢) الاثر، فإنك لن تخطئ في الطريق ما دمت على الاثر (٣).
ريفرينس و تحكيم الحدیث:
(١) في [هـ]: (عبيد اللَّه).
(٢) في [هـ]: (فافتقر).
(٣) صحيح.
Muhammad bin Sirin narrates that Ubaidullah bin Ziyad intended to make a uterine sister an heir in the presence of the grandfather, and he said that Hazrat Umar (may Allah be pleased with him) had made a uterine sister an heir along with the grandfather. So Hazrat Abdullah bin Utbah said: "I am neither a Saba'i nor a Khariji, therefore you should follow the hadith, because as long as you follow the hadith, you will not go astray from the straight path."

٣٣٣٤٠ - حدثنا وكيع قال: ثنا إسماعيل عن الشعبي قال: ما ورث احد من اصحاب النبي ﷺ إخوة من ام مع جد (١).
ريفرينس و تحكيم الحدیث:
(١) صحيح.
Shu'bi narrates that none of the companions of the Messenger of Allah (peace be upon him) made a maternal sister an heir in the presence of a paternal uncle.

٣٣٣٤١ - حدثنا معاوية بن هشام قال: ثنا سفيان عن الاعمش عن إبراهيم قال: كان زيد لا يورث اخا لام ولا اختا لام مع جد شيئا (١).
ريفرينس و تحكيم الحدیث:
(١) منقطع؛ إبراهيم لم يدرك زيدًا.
Ibrahim states that Hazrat Zaid (may Allah be pleased with him) did not make maternal half-brothers and maternal half-sisters heirs in the presence of the grandfather.

٣٣٣٤٢ - حدثنا وكيع قال: حدثنا سفيان عن الاعمش عن إبراهيم قال: كان علي وعبد الله لا يورثان الإخوة من الام مع الجد شيئا (١).
ريفرينس و تحكيم الحدیث:
(١) منقطع؛ إبراهيم لم يدركهما.
It is narrated from Ibrahim that Hazrat Ali (may Allah be pleased with him) and Hazrat Abdullah (may Allah be pleased with him) would not make maternal brothers and sisters heirs to anything in the presence of the grandfather. Hazrat Abu Bakr says that this issue will be resolved from a single share, because all the wealth will go to the grandfather.

٣٣٣٤٣ - قال ابو بكر: فهذه من سهم واحد لان المال كله للجد.
33343 - Abu Bakr said: So this is from one share because all the wealth belongs to the grandfather.
