٣٣٥٣٦ - حدثنا حماد بن مسعدة عن ابن ابي ذئب عن عبد الواحد بن ابي عون قال: قال محمد بن جبير: القاتل عمدا لا يرث من الدية ولا من غيرها شيئا، والقاتل خطا لا يرث من الدية شيئا، ويرث من غيرها إن كان.
Abdul Wahid bin Abi Aun narrates that Muhammad bin Jubair said: Whoever kills intentionally will not inherit blood money or any other property, and whoever kills by mistake will not inherit blood money, but if there is any other property, he will inherit it.

٣٣٥٣٧ - حدثنا عبد الوهاب الثقفي عن يحيى بن سعيد عن عروة قال: لا يرث القاتل.
Yahya bin Saeed narrates the statement of Hazrat Urwah that the killer will not be an heir.

Hisham narrates from his father, he said, that the murderer will not inherit any portion of the wealth.

٣٣٥٣٩ - حدثنا ابن ابي (غنية) (١) عن ابيه عن الحكم قال: إذا قتل الرجل ابنه او اخاه لم يرثه، وورثه اقرب الناس بعده.

Abu Ghaniyyah narrates that Hazrat Hakam said: When a man kills his son or brother, he will not be his heir; apart from him, the person who is closer to the deceased will be his heir.

٣٣٥٤٠ - حدثنا إسماعيل بن عياش عن ابن جريج عن عطاء قال: إن قتله خطا (ورثه) (١) من ماله، ولم يرث من ديته، وإن قتله عمدا لم يرث من ماله ولا من ديته.
ريفرينس و تحكيم الحدیث:
(١) في [م]: (ورث).
Ibn Jurayj narrates from Hazrat Ata that he said: If the killer kills by mistake, then he will inherit from the deceased's property but not from the deceased's blood money. However, if he kills intentionally, then he will neither inherit from his property nor from his blood money.

٣٣٥٤١ - حدثنا عبد الاعلى عن معمر عن الزهري قال: إذا قتل وليه خطا ورث من ماله، ولم يرث من ديته، وإن قتله عمدا لم يرث من ماله ولا من ديته.
Muammar narrates that Zuhri said, when a person mistakenly kills his guardian, he will not inherit his wealth.

٣٣٥٤٢ - حدثنا وكيع قال: ثنا علي بن مبارك عن يحيى بن ابي كثير عن علي في رجل قتل امه (فقال) (١): إن كان خطا ورث، وإن كان عمدا لم يرث (٢).

(٢) منقطع؛ يحيى لا يروي عن علي.
Yahya bin Abi Kathir narrates that Hazrat Ali (may Allah be pleased with him) said about the man who killed his mother, that if he killed her by mistake, he will be an heir, and if he killed her intentionally, he will not be an heir. Waki’ says that both the one who kills intentionally and the one who kills by mistake will inherit the blood money, not the property.

33543 - Waki‘ said: A deliberate or accidental killer does not inherit from the blood money nor from the wealth.

٣٣٥٤٤ - حدثنا يحيى بن يعلى عن منصور عن إبراهيم قال: لا يرث القاتل.
Mansur narrates that Ibrahim said: The killer will not be an heir.

٣٣٥٤٥ - حدثنا وكيع عن سفيان عن منصور عن إبراهيم قال: لا يرث القاتل شيئا من ديته ولا من ماله.
Mansur narrates that the killer will not inherit the blood money of the murdered person, nor his property.
