Regarding Those Who Say That the Wala' Belongs to the Closest Relative of the Deceased

٣٣٧١٢ - حدثنا ابن فضيل عن مغيرة عن إبراهيم ان عليا وعبد الله وزيدا قالوا: الولاء (للكبر) (١) (٢).

Ibrahim says that Hazrat Ali (may Allah be pleased with him), Abdullah (may Allah be pleased with him), and Zaid (may Allah be pleased with him) used to say that the right of wala belongs to the eldest.

٣٣٧١٣ - حدثنا وكيع قال: حدثنا سفيان عن منصور عن إبراهيم عن عمر وعبد الله وزيد قالوا: الولاء (للكبر) (١) (٢).

Ibrahim narrates from Hazrat Umar, Abdullah, and Zaid (may Allah be pleased with them) that the right of wala’ belongs to the eldest.

٣٣٧١٤ - حدثنا ابن إدريس عن الشيباني عن الشعبي عن شريح انه قضى فيه كما يقضي في المال.
Shu’bi narrates that Shurayh gave the same verdict regarding this as is given in the case of wealth, and ‘Ali (may Allah be pleased with him) and Zayd (may Allah be pleased with him) used to give it to the elder.

33715 - He said: And Ali and Zayd used to consider it (for old age) (1) (2).

٣٣٧١٦ - حدثنا وكيع قال: ثنا مسعر وسفيان عن عمران بن مسلم بن رياح الثقفي عن عبد الله بن معقل عن علي قال: الولاء شعبة من الرق، فمن احرز الميراث احرز الولاء (١).
ريفرينس و تحكيم الحدیث:
(١) صحيح؛ عمران ثقة.
Abdullah bin Ma’qil narrates from Hazrat Ali (may Allah be pleased with him) that he said: Wala’ (the bond of allegiance) is a branch of slavery, so whoever inherits will also receive the wala’.

٣٣٧١٧ - حدثنا وكيع عن مسعر عن ابن رياح عن سالم بن عبد الله قال: الولاء (للكبر) (١).

Ibn Riyah narrates that Salim bin Abdullah says that the right of wala’ (allegiance/freed slave’s loyalty) belongs to the elder.

٣٣٧١٨ - حدثنا وكيع قال: ثنا سفيان عن ليث عن طاوس قال: الولاء (للكبر) (١).

Laith narrates that Hazrat Tawus said that the right of wala’ is for the elder.

٣٣٧١٩ - حدثنا وكيع ثنا سفيان (عن قيس) (١) بن مسلم عن ابي مالك الغفاري قال: (إذا مات) (٢) المعتق الاول (فايكم) (٣) من يرثه فله ولاء مولاه.

Qais bin Muslim narrates that Abu Malik Ghafari said: When the first emancipator dies, whoever is his heir, the allegiance (wala’) of his freed slave belongs to him.

٣٣٧٢٠ - حدثنا هشيم عن يونس عن ابن سيرين قال: إذا مات مولى القوم نظر إلى اقرب الناس منه فجعل له ميراثه.
It is narrated from Yunus ibn Sirin that when the freed slave of a group dies, the closest person among them will be considered, and the inheritance will be given to him.

٣٣٧٢١ - حدثنا وكيع عن ابي عاصم عن الشعبي قال: كان شريح يجري الولاء مجرى المال.
Sha'bi narrates that Shurayh used to consider wala' (the right of inheritance through allegiance) as equivalent to property. Sha'bi narrates that the people of Madinah used to say that wala' is for the elder.
