To Whom Is the Khums Given and Where Is It Used?

٣٥٥٣٩ - حدثنا عبد الرحمن بن مهدي عن محمد بن راشد عن مكحول قال: الخمس بمنزلة الفيء، (يعطي) (١) منه الإمام الغني والفقير.
ريفرينس و تحكيم الحدیث:
(١) في [أ، ب]: (يعطي).
Hazrat Mak’hool (may Allah be pleased with him) says that khums is also like fai; from it, the Imam will give to both the rich and the poor. Hazrat Umar bin Abdul Aziz wrote: The way of general fai is also the way of khums.

٣٥٥٤٠ - قال: واخبرني ليث بن ابي رقية اين عمر بن عبد العزيز كتب ان سبيل الخمس سبيل عامة الفيء.
35540 - He said: And Laith ibn Abi Ruqayya informed me where Umar ibn Abd al-Aziz wrote that the way of the khums is the same as the way of the general fay’.

٣٥٥٤١ - حدثنا كثير بن هشام عن جعفر بن برقان قال: ثنا ثابت بن الحجاج قال: بلغني ان رجلين من بني عبد المطلب اتيا النبي ﷺ يسالانه من الصدقة فقال:"لا ولكن إذا رايتما عندي شيئا من الخمس فاتياني" (١).

(١) مرسل؛ ثابت بن الحجاج تابعي.
Hazrat Hajjaj bin Thabit narrates that news reached me that two persons from Banu Abdul Muttalib came to the service of the Holy Prophet (peace be upon him) and asked for charity. The Holy Prophet (peace be upon him) said: Not now, but when you see that I have the wealth of khums with me, then come to me (I will give it to you).

٣٥٥٤٢ - حدثنا وكيع قال: ثنا شريك عن خصيف عن مجاهد قال: كان آل محمد ﷺ لا (تحل) (١) لهم الصدقة، فجعل لهم خمس الخمس (٢).
ريفرينس و تحكيم الحدیث:
(١) في [ط، هـ]: (يحل).
(٢) مرسل ضعيف؛ مجاهد تابعي، وخصيف ضعيف.
Hazrat Mujahid says that charity is not permissible for the family of Muhammad صلی اللہ علیہ وسلم . They will receive one-fifth of the one-fifth (of the spoils of war).

٣٥٥٤٣ - حدثنا سهل بن يوسف عن عمرو عن الحسن ان عمر اعطى الرجل من الفيء عشرة آلاف وتسعة وثمانية وسبعة (١).
ريفرينس و تحكيم الحدیث:
(١) منقطع؛ الحسن لا يروي عن عمر.
It is narrated from Hasan that Hazrat Umar (may Allah be pleased with him) gave one person ten thousand, nine thousand, eight thousand, and seven thousand from the spoils of war.

٣٥٥٤٤ - حدثنا عفان قال: ثنا عبد الواحد بن زياد قال: ثنا حجاج بن ارطاة قال: ثنا ابو الزبير عن جابر بن عبد الله قال: سئل كيف كان رسول الله ﷺ ⦗٤٣٠⦘ يصنع بالخمس؟ قال: (كان) (١) يحمل منه في سبيل الله الرجل ثم الرجل ثم الرجل (٢).

(١) سقط من: [أ، ب].
(٢) حسن؛ حجاج بن أرطأة، أخرجه أحمد (١٤٩٣٢).
Hazrat Jabir bin Abdullah (may Allah be pleased with him) was asked how the Noble Prophet (peace and blessings be upon him) used to distribute the khums. Hazrat Jabir (may Allah be pleased with him) said: The Prophet of Allah (peace be upon him) would give from it to one mujahid, then to another, then to a third.
