Chapter on the grandfather
Hadith Number: 38
نا هشيم ، قال: انا يونس بن عبيد ، قال: نا الحسن ، ان عمر بن الخطاب، نشد الناس , فقال: من كان منكم عنده علم من رسول الله صلي الله عليه وسلم في الجد فليقم , فقام معقل بن يسار المزني , فقال: قضى رسول الله صلي الله عليه وسلم في جد كان فينا , قال: كم اعطاه؟ قال:" اعطاه السدس" ، قال: مع من؟ قال: لا ادري , قال: لا دريت".
Sayyiduna Umar bin Khattab (may Allah be pleased with him) said to the people: "Whoever among you has knowledge from the Messenger of Allah (peace and blessings be upon him) regarding the grandfather, let him stand up." Sayyiduna Ma'qil bin Yasar Al-Muzani (may Allah be pleased with him) stood up and said: "The Messenger of Allah (peace and blessings be upon him) gave a ruling among us regarding the grandfather." Umar (may Allah be pleased with him) asked: "How much did he give him?" He said: "One-sixth." He asked: "With whom?" He said: "I do not know." He (Umar) said: "Then you do not know anything."

Hadith Number: 39
نا نا ابو معشر، عن عيسى بن ابي عيسى الحناط، قال: سال عمر بن الخطاب الناس، فقال: ايكم سمع رسول الله صلي الله عليه وسلم قال في الجد شيئا؟ فقال رجل: انا، فقال: ما اعطاه؟ قال:" اعطاه سدس ماله" , قال: ماذا معه من الورثة؟ قال: لا ادري , قال: لا دريت، وقال آخر: لي علم يا امير المؤمنين ماذا اعطى الجد؟" اعطاه ثلث ماله" , قال: ماذا معه من الورثة؟ قال: لا ادري , قال: لا دريت، قال آخر: لي علم. ماذا اعطاه؟ اعطاه نصف ماله، قال: ماذا معه من الورثة؟ قال: لا ادري , قال: لا دريت، قال آخر: لي علم. ما اعطاه؟ قال: اعطاه المال كله , قال: ماذا معه من الورثة؟ قال: لا ادري، قال: لا دريت . فلما وضع زيد بن ثابت الفرائض" اعطاه سدس ماله مع الولد الذكر، واعطاه ثلث ماله مع الإخوة، واعطاه نصف ماله مع الاخ واعطاه المال كله إذا لم يكن له وارث".
Sayyiduna Umar bin Khattab (may Allah be pleased with him) asked the people: "Who has heard anything from the Messenger of Allah (peace and blessings be upon him) regarding the grandfather?" A man said: "I have." He asked: "What was given?" He said: "One-sixth of the wealth." He asked: "Who were the heirs with him?" He said: "I do not know." He said: "You know nothing." Another said: "I have knowledge; the grandfather was given one-third of the wealth." Then the same question and answer. A third said: "He was given half of the wealth." A fourth said: "He was given all the wealth." Umar (may Allah be pleased with him) said to all: "If you do not know, then you know nothing." Then, when Sayyiduna Zayd bin Thabit (may Allah be pleased with him) determined the shares of inheritance, he gave the grandfather one-sixth with the son, one-third with brothers, half the wealth with one brother, and if there was no heir, he gave all the wealth.

Hadith Number: 40
نا نا هشيم، قال: انا خالد الحذاء، قال: نا ابو المتوكل الناجي، عن ابي سعيد الخدري، ان ابا بكر ،" كان ينزل الجد ابا" .
Sayyiduna Abu Bakr Siddiq (may Allah be pleased with him) used to consider the grandfather in the position of the father.

Hadith Number: 41
نا نا خالد بن عبد الله بن خالد الحذاء، عن ابي نضرة، عن ابي سعيد الخدري، ان ابا بكر ،" يجعل الجد ابا" .
It is narrated from Sayyiduna Abu Sa'id Khudri (may Allah be pleased with him) that Sayyiduna Abu Bakr (may Allah be pleased with him) used to give the grandfather the status of the father.

Hadith Number: 42
ثنا ثنا هشيم، ثنا خالد الحذاء، عن عكرمة، عن ابن عباس، ان ابا بكر ،" كان ينزل الجد ابا" .
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that Sayyiduna Abu Bakr (may Allah be pleased with him) used to place the grandfather in the position of the father.

Hadith Number: 43
نا نا خالد بن عبد الله، عن ابي إسحاق الشيباني، عن ابي بردة، عن مروان بن الحكم، عن عثمان بن عفان، ان ابا بكر " كان يجعل الجد ابا" .
It is narrated from Sayyiduna Uthman bin Affan (may Allah be pleased with him) that Sayyiduna Abu Bakr (may Allah be pleased with him) used to give the grandfather the status of the father.

Hadith Number: 44
نا نا ابو معاوية الضرير، عن ابي إسحاق الشيباني، عن سعيد بن ابي بردة، عن ابيه، ان عمر بن الخطاب، كتب إلى ابي موسى الاشعري ان اجعل الجد ابا، فإن ابا بكر ، جعل الجد ابا" .
Sayyiduna Umar bin Khattab (may Allah be pleased with him) wrote a letter to Sayyiduna Abu Musa Ash'ari (may Allah be pleased with him) stating: "Consider the grandfather as the father, because Abu Bakr (may Allah be pleased with him) regarded the grandfather as the father."

Hadith Number: 45
نا نا هشيم، قال: انا منصور، ويونس، عن الحسن، ان ابا بكر ،" كان ينزل الجد بمنزلة الوالد" .
It is narrated from Hasan (may Allah have mercy on him) that Sayyiduna Abu Bakr (may Allah be pleased with him) used to consider the grandfather in the place of the father.

Hadith Number: 46
نا نا خالد بن عبد الله، عن ليث بن ابي سليم، عن عطاء، ان ابا بكر ، وعثمان، وابن عباس " كانوا يجعلون الجد ابا" . وقال ابن عباس : " يرثني ابني دون اخي، ولا ارث ابني دون اخيه" .
It is narrated from Ata (may Allah have mercy on him) that Sayyiduna Abu Bakr, Sayyiduna Uthman, and Sayyiduna Ibn Abbas (may Allah be pleased with them) considered the grandfather as (equivalent to) the father. Ibn Abbas (may Allah be pleased with them both) said: "My son will inherit from me, not my brother, and I will not become the heir of my son in the presence of his brother."

نا نا إسماعيل بن إبراهيم، قال: نا ايوب، عن ابن ابي مليكة، عن عبد الله بن الزبير، ان ابا بكر ،" جعل الجد ابا" .
It is narrated from Sayyiduna Abdullah bin Zubair (may Allah be pleased with him) that Sayyiduna Abu Bakr (may Allah be pleased with him) used to consider the grandfather as (equivalent to) the father.
