كِتَابُ وِلَايَةِ الْعَصَبَةِ
Book of Agnatic Guardianship ('Asabah)
بَابُ الرَّجُلِ إِذَا لَمْ يَكُنْ لَهُ وَارِثٌ يَضَعُ مَالَهُ حَيْثُ شَاءَ
Chapter on a man who has no heir and may dispose of his wealth as he wishes
Hadith Number: 215
نا نا سفيان، قال: حدثني ابو إسحاق، عن عمرو بن شرحبيل، قال: قال عبد الله : " إنكم معاشر همدان من احجا حي بالكوفة , يموت احدكم ولا يترك عصبة , فإذا كان كذلك فليوص بماله كله" .
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "O people of Hamdan! You are most likely among those that if one of you dies and leaves no 'asaba (male heirs), therefore, he should make a will regarding his wealth."

Hadith Number: 216
نا نا ابو وكيع، عن ابي إسحاق، عن ابي ميسرة، قال سعيد: هو عمرو بن شرحبيل , قال: قال لي عبد الله :" يا ابا ميسرة إنكم معاشر همدان يموت فيكم الميت لا يدرى من عصبته , فإذا كان كذلك فليضع ماله حيث شاء" .
Abdullah bin Mas'ud (may Allah be pleased with him) said: "O Abu Maisarah! It often happens in your tribe that the 'Asabah (male agnate relative) of the deceased is not known, so he should make a bequest of his wealth wherever he wishes."

Hadith Number: 217
نا نا ابو معاوية، قال: نا الاعمش، عن إبراهيم، عن همام بن الحارث، عن عمرو بن شرحبيل، قال: قال لي عبد الله : " إنكم معاشر اهل اليمن من اجدر الناس ان يموت الرجل منكم ولا يدع عصبة، فإذا كان كذلك فليضع الرجل ماله حيث شاء" .
Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) said: "O people of Yemen! You are most likely to have no 'Asabah (male agnate heirs) for the deceased, therefore, he should make a bequest of his wealth wherever he wishes."

Hadith Number: 218
نا نا هشيم، قال: انا مغيرة، عن إبراهيم، ان ابن مسعود قال لابي معمر:" يا ابا معمر , إنكم معاشر اهل اليمن مما يموت فيكم الميت لا يدرى من عصبته، فإذا كان احدكم كذلك فليوص ماله كله حيث شاء" .
Abdullah bin Mas'ud (may Allah be pleased with him) said to Abu Ma'mar: "O Abu Ma'mar! You are from the people of Yemen, and among you, most of the deceased do not have known 'Asabah (male agnate heirs). Therefore, when any of you dies, he should make a complete bequest of his wealth wherever he wishes."

نا هشيم، قال: انا يونس، وهشام، وابن عون، ومنصور , عن ابن سيرين، قال: قلت لعبيدة: " رجل ليس له عصبة تعرف، ولا لاحد عليه عقد ايوصي بماله كله؟ قال:" نعم إن شاء" .
Ibn Sirin (may Allah have mercy on him) said: I asked ‘Ubaidah (may Allah have mercy on him),“If a person has no ‘asaba (male agnate heirs) and no covenant with anyone, can he bequeath all his wealth?”He replied:“Yes, if he wishes.”

Hadith Number: 220
نا سفيان، عن ايوب، عن محمد بن سيرين، قال: سالت عبيدة عن رجل لم يعاقد احدا وليست له عصبة تعرف , ايوصي بماله كله؟ قال:" يوصي بماله كله إن شاء" .
Ibn Sirin (may Allah have mercy on him) says: I asked Ubaidah (may Allah have mercy on him), and he said: "If someone has not made a contract and no 'asaba (male agnate relative) is recognized, then if he wishes, he may bequeath all of his wealth."

نا سفيان، عن ابن ابي خالد، عن الشعبي، عن مسروق مثله.
Sha'bi (may Allah have mercy on him) narrates from Masruq (may Allah have mercy on him) in the same manner.

نا سفيان، عن ابن ابي خالد، عن الشعبي، ان مسروقا، كان يقول فيمن ليس لاحد عليه نعمة" يوصي بماله كله إن شاء" .
Shu'bi (may Allah have mercy on him) says: Masruq (may Allah have mercy on him) used to say: "Whoever does not owe a favor to anyone, if he wishes, may bequeath all of his wealth."
