Hadith Number: 271
Ibn Sirin (may Allah have mercy on him) said: "When a freed slave dies, it should be seen who is the closest to the one who freed him; the inheritance should be given to that person."

The Messenger of Allah (peace and blessings be upon him) said: "The freed slave is a brother and a blessing in religion, and the one most entitled to his inheritance is the one who is closest to the emancipator."

Sayyiduna Ali and Sayyiduna Zubair (may Allah be pleased with them both) disputed regarding the freed slaves of Safiyyah. Sayyiduna Ali (may Allah be pleased with him) said: "I will pay their blood money and I will be their heir." Sayyiduna Zubair (may Allah be pleased with him) said: "They are the freed slaves of my mother and I will be their heir." Then Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) said: "You do not know which of you will die first." So both of them became silent.

Sayyiduna Ali and Sayyiduna Zubair (may Allah be pleased with them both) came to Sayyiduna Umar (may Allah be pleased with him) regarding the matter of the mawla of Safiyyah. Sayyiduna Ali (may Allah be pleased with him) said: "He is the mawla of my paternal aunt, and I will pay his blood money." Sayyiduna Zubair (may Allah be pleased with him) said: "He is the mawla of my mother, and I will be his heir." So Sayyiduna Umar (may Allah be pleased with him) decided that: "The inheritance will go to Zubair (may Allah be pleased with him), and the blood money will be upon Ali (may Allah be pleased with him)." And he said: "The guardianship will be for the family of Zubair as long as their lineage remains." It was asked: "What is meant by lineage?" He replied: "A son; if there is no son, then the guardianship will return to Ali (may Allah be pleased with him)."

Ash-Sha'bi, may Allah have mercy on him, said: "The guardianship of Safiyyah's freed slaves was given to Zubayd bin Harun bin Zubair bin Al-Awwam, not to Abbas, and the guardianship of Umm Hani's freed slaves was given to Ja'idah bin Hubayrah, not to Ali, may Allah be pleased with him."
