كِتَابُ وِلَايَةِ الْعَصَبَةِ
Book of Agnatic Guardianship ('Asabah)
بَابُ الرَّجُلِ يُوصِي لِلرَّجُلِ فَيَمُوتُ الْمُوصَى لَهُ
Chapter: A man bequeaths to another man, but the legatee dies
Hadith Number: 377
نا هشيم، قال: انا هشام، عن ابن سيرين، انه كان يقول ذلك ايضا.
Ibn Sirin, may Allah have mercy on him, said the same.

Hadith Number: 378
نا هشيم، قال: انا حميد الطويل، عن الحسن , انه كان يامر بالوصية لذي قرابته، فقيل له: وإن كانوا اغنياء؟ قال:" إن غناءهم لا يمنعهم من الحق الذي جعله الله لهم" .
When Hasan al-Basri (may Allah have mercy on him) was asked whether a bequest should also be made for the relatives of wealthy people, he replied: "Their wealth does not prevent them from the right that Allah has prescribed for them."

Hadith Number: 379
نا هشيم، عن جويبر، عن الضحاك، قال: " من مات ولم يوص لذي قرابته فقد ختم عمله بمعصية" .
Dhahhak (may Allah have mercy on him) said: "Whoever does not make a bequest for his close relatives has ended his deeds with disobedience."

Hadith Number: 380
نا هشيم، قال: انا جويبر، عن الضحاك، قال: " لو كنت واليا فاتيت برجل اوصى لغير ذي قرابته , رددت ذلك ولو بنيت به الدور , واتخذت به الاموال" .
Dhahhak (may Allah have mercy on him) said: "If I were a ruler and someone brought me a bequest for a non-relative, I would reject it, even if palaces were built or wealth was accumulated from it."

Hadith Number: 381
نا ابو معاوية، قال: نا ابو عاصم الثقفي، قال: قال لي إبراهيم النخعي: ما تقول في رجل اوصى بنصف ماله، وثلث ماله، وربع ماله؟ قلت: لا يجوز، قال: فإنهم قد اجازوا، قلت: لا ادري، قال:" امسك اثنتي عشرة فاخرج نصفها ستة، وثلثها اربعة، وربعها ثلاثة , فاقسم المال على ثلاثة عشر فلصاحب النصف ستة، ولصاحب الثلث اربعة، ولصاحب الربع ثلاثة" .
Ibrahim Nakha'i (may Allah have mercy on him) said: "If a person makes a bequest of half, a third, and a quarter of his wealth, then twelve dirhams will be assumed; half of them is six dirhams, a third is four dirhams, and a quarter is three dirhams. Then the wealth will be divided into thirteen parts; the one with half will get six, the one with a third will get four, and the one with a quarter will get three shares."
