Sunan Saeed bin Mansur
كِتَابُ وِلَايَةِ الْعَصَبَةِ
Book of Agnatic Guardianship ('Asabah)
بَابُ الرَّجُلِ يَسْتَأْذِنُ وَرَثَتَهُ فَيُوصِي بِأَكْثَرَ مِنَ الثُّلُثِ
Chapter: A man seeks permission from his heirs to bequeath more than a third
Hadith Number: 388
نا هشيم، قال: انا داود بن ابي هند، قال: نا الشعبي، عن شريح , انه قال في رجل استاذن ورثته فاذنوا له ان يوصي باكثر من الثلث ففعل، فلما مات ابوا ان يجيزوا وصيته , قال شريح: " إن القوم قد يستحيوا من صاحبهم ما كان حيا بين اظهرهم، فإذا نفضوا ايديهم من التراب فهم بالخيار إن شاءوا اجازوا، وإن شاءوا ردوا" .
Shurayh (may Allah have mercy on him) said: "If a person makes a bequest of more than one-third with the permission of his heirs, and after his death the heirs refuse, then they are free; if they wish, they may permit it, and if they wish, they may prevent it, because it is possible that during his lifetime they felt shy, and after his death they refused."

نا هشيم، قال: انا عبيدة، عن إبراهيم، قال: وانبئت عن منصور، عن إبراهيم، انه كان يقول ذلك.
This same statement is also narrated from Ibrahim Nakha'i (may Allah have mercy on him) and Mansur (may Allah have mercy on him).

Hadith Number: 390
نا نا هشيم، قال: انا المسعودي، عن محمد بن عبيد الله الثقفي، عن القاسم بن عبد الرحمن، قال المسعودي واظنني سمعته من القاسم، قال: قال عبد الله : " ذلك التكره لا يجوز" .
Qasim bin Abdur Rahman (may Allah have mercy on him) narrated from Sayyiduna Abdullah (may Allah be pleased with him): "This is disliked and this is not permissible."

Hadith Number: 391
نا هشيم، انا ايوب بن العلاء، قال: سمعت الحكم بن عتيبة، يحدث عن ابن مسعود، مثل ذلك.
The same statement is also narrated from Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him).

Hadith Number: 392
نا هشيم، قال: انا يونس، عن الحسن , انه كان يقول: " إذا اذنوا له فليس لهم ان يرجعوا بعد موته" .
Hasan al-Basri (may Allah have mercy on him) said: "If the heirs gave permission during the lifetime, then after death they cannot take that permission back."

نا خالد بن عبد الله، عن يونس، عن الحسن، مثله.
This same narration is also reported from Hasan al-Basri (may Allah have mercy on him) through another chain.
