Sunan Saeed bin Mansur
كِتَابُ وِلَايَةِ الْعَصَبَةِ
Book of Agnatic Guardianship ('Asabah)
بَابُ الرَّجُلِ يُعْتِقُ عِنْدَ مَوْتِهِ وَلَيْسَ لَهُ مَالٌ غَيْرُهُ
Chapter: A man frees a slave at his death and has no other wealth
Hadith Number: 406
نا هشيم ، قال: انا حجاج ، عن العلاء بن بدر ، عن ابي يحيى المكي ، ان رجلا اعتق غلاما له عند موته، وليس له مال غيره، وعليه دين" فامر رسول الله صلى الله عليه وسلم ان يسعى في قيمته" .
A man set his slave free at the time of his death while he had no other wealth and was in debt, so the Messenger of Allah (peace be upon him) said: "The value of the slave should be used to pay off the debt."

Hadith Number: 407
نا هشيم ، قال: انا خالد ، عن ابي قلابة ، عن رجل من بني عذرة , ان رجلا منهم اعتق غلاما له عند موته، ولم يكن له مال غيره، فرفع ذلك إلى رسول الله صلى الله عليه وسلم،" فاعتق منه الثلث، واستسعى في الثلثين" .
A man freed his slave at the time of his death, and he had no other wealth. So the Messenger of Allah (peace be upon him) said: "One third of the slave should be freed, and the slave should be ordered to work to pay the price of the remaining two thirds."

Hadith Number: 408
نا هشيم ، قال: انا منصور ، عن الحسن ، عن عمران بن حصين ، ان رجلا من الانصار اعتق ستة مملوكين له عند موته، ليس له مال غيرهم، فبلغ ذلك النبي صلى الله عليه وسلم، فغضب من ذلك , وقال:" لقد هممت ان لا اصلي عليه , ثم دعا مملوكيه فجزاهم ثلاثة اجزاء فاقرع بينهم، فاعتق اثنين وارق اربعة" .
An Ansari, at the time of his death, freed his six slaves while he had no other wealth. When this reached the Prophet (peace be upon him), he became angry and said: "I intended not to pray over him." Then he drew lots, freed two slaves, and kept four in slavery.

Hadith Number: 409
نا هشيم ، قال: انا خالد ، قال: نا ابو قلابة ، عن ابي زيد الانصاري ، عن النبي صلى الله عليه وسلم مثل ذلك.
Abu Qilabah (may Allah have mercy on him) narrated a similar report from Abu Zayd Al-Ansari (may Allah be pleased with him) from the Prophet (peace and blessings of Allah be upon him).

Ibn Sirin (may Allah have mercy on him) narrated from the Prophet (peace be upon him) in the same manner.

نا سفيان , عن يزيد بن يزيد بن جابر ، عن مكحول ، عن سعيد بن المسيب ، ان رجلا اعتق ستة اعبد له في مرضه،" فاقرع رسول الله صلى الله عليه وسلم بينهم، فاعتق اثنين وارق اربعة" .
It is narrated from Sa'id bin al-Musayyib (may Allah have mercy on him) that the Prophet (peace and blessings be upon him) drew lots among six slaves, freed two, and left four as slaves.

Hadith Number: 412
نا هشيم، قال: انا مغيرة، عن إبراهيم , قال: " يستسعون، فيعتق منهم الثلث، ويسعون في الثلثين" .
Ibrahim al-Nakha'i (may Allah have mercy on him) said: "One third of the slaves will be set free, and two thirds will work to pay off their price."

نا هشيم، قال: انا إسماعيل بن ابي خالد، عن الشعبي، بمثل قول إبراهيم.
A similar narration is also reported from Ash-Sha'bi, may Allah have mercy on him.

نا هشيم، قال: انا مطرف، عن الشعبي، انه سمعه يقول مثل ما قال إبراهيم.
There is another narration from Al-Sha'bi, may Allah have mercy on him, with the same meaning.

نا هشيم، قال: انا يونس، عن الحسن، انه كان يقول مثل قول إبراهيم والشعبي: " إذا لم يكن عليه دين، فإذا كان عليه دين اكثر من قيمته فهو رقيق يباع، إلا ان يكون الدين اقل من قيمته بدرهم واحد فما سوى ذلك، فإذا كان كذلك وقعت السعاية" .
Hasan al-Basri (may Allah have mercy on him) said: "If a slave has no debt, then one-third will be freed and two-thirds will work, and if the slave has such a debt that it is more than his value, then he will be sold."
