كِتَابُ النِّكَاحِ
Book of Marriage
بَابُ مَا جَاءَ فِي الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ فَيَدْخُلُ بِهَا قَبْلَ أَنْ يَفْرِضَ شَيْئًا
Chapter: What is reported regarding a man marrying a woman and consummating before specifying the dowry
Hadith Number: 744
نا جرير بن عبد الحميد ، عن منصور ، عن طلحة بن مصرف ، عن خيثمة ، قال جرير: اراه عن عائشة رضي الله عنها , قالت:" إن رجلا من المسلمين ليس له شيء تزوج امراة فامره رسول الله صلى الله عليه وسلم ان تدخل عليه امراته واوصاهم خيرا، فاصاب الرجل بعد حتى صار من اشراف الناس" .
It is narrated from Sayyida Aisha (may Allah be pleased with her): "A Muslim man had nothing, yet he married a woman. The Messenger of Allah (peace and blessings be upon him) ordered that his wife be sent to him and advised them to treat each other well. Later, that man became wealthy and was counted among the nobles."

Hadith Number: 745
نا ابو معاوية , قال: نا حجاج ، عن طلحة بن مصرف ، عن خيثمة ، ان رجلا من الانصار تزوج , فقالوا: يا رسول الله , إنه فقير وليس عنده شيء افندخلها عليه , ولم يعطها شيئا من صداقها؟ قال:" نعم ادخلوها عليه" .
It is narrated from Hazrat Khaythamah (may Allah have mercy on him) that an Ansari man got married. The companions said: "O Messenger of Allah! He is poor, he has nothing for the dowry. Should we allow him to be alone with his wife?" The Prophet (peace and blessings be upon him) said: "Yes, send his wife to him."

Hadith Number: 746
نا نا هشيم، قال: انا ابو حمزة عمران بن ابي عطاء , قال: سمعت ابن عباس , يقول وساله رجل فقال: إنه تزوج امراة وانه اعسر عن صداقها , فقال:" إن لم تجد إلا إحدى نعليك فاعطها إياها , وادخل بها" .
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them) that a man asked him: "I have married a woman but I am unable to pay the dowry." He replied: "If you have even a shoe, give it to her and go to your wife."

Hadith Number: 747
نا ابو معاوية، قال: نا حجاج، عن الركين بن الربيع، عن ابيه , انه " تزوج فلان بن هرمز , ليلى بنت العجماء في زمن عمر بن الخطاب رضي الله عنه على اربعة آلاف , ثم دخل بها قبل ان يعطيها من صداقها شيئا" .
It is narrated that Fulan bin Harmuz married Sayyida Laila bint al-Ajma’ during the time of Sayyiduna Umar bin Khattab (may Allah be pleased with him) with a dowry of four thousand, and he went to his wife without paying the dowry.

Hadith Number: 748
نا نا ابو عوانة، عن عمران بن ابي عطاء، عن ابن عباس , انه: " يكره ان يدخل، بامراته حتى يعطيها شيئا" .
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that he considered it necessary to give some dowry before going to the wife.

Hadith Number: 749
نا هشيم، قال: انا حجاج، عن ابي إسحاق، ان كريب بن ابي مسلم، وكان من اصحاب عبد الله، " تزوج امراة على اربعة آلاف فدخل بها قبل ان يعطيها شيئا" .
Hazrat Kuraib bin Abi Muslim, may Allah have mercy on him, married with a dowry of four thousand and went to his wife without giving the dowry.

Hadith Number: 750
نا ابو معاوية، قال: نا الحجاج، عن ابي إسحاق، عن كريب بن هشام، وكان من اصحاب عبد الله،" انه تزوج امراة على اربعة آلاف، ثم دخل بها قبل ان يعطيها من صداقها شيئا" .
Hazrat Kuraib bin Hisham, may Allah have mercy on him, also did the same.

Hadith Number: 751
نا هشيم، قال: انا يونس، عن الحسن، وانا مغيرة، عن إبراهيم ," انهما كانا لا يريان باسا ان يدخل الرجل بامراته قبل ان يعطيها شيئا" .
Hasan al-Basri (may Allah have mercy on him) and Ibrahim al-Nakha'i (may Allah have mercy on him) both did not see any harm in not giving any part of the dowry before going to the wife.

Hadith Number: 752
نا هشيم، قال: انا منصور، عن الحسن، قال: " كانت المراة من اهل المدينة إذا تزوجت ارسلت إلى زوجها: ان بت عندنا لكي استوجب الصداق، وذلك قبل ان يعطيها شيئا" .
Hasan al-Basri (may Allah have mercy on him) said: "A woman of Madinah would call her husband after marriage so that he would spend the night with her and the dowry would become obligatory, even though nothing had yet been given."

Hadith Number: 753
نا هشيم، عمن سمع قتادة يحدث , عن سعيد بن المسيب،" انه كان لا يرى باسا ان يدخل بها قبل ان يعطيها شيئا" .
It is narrated from Hazrat Sa'id bin al-Musayyib (may Allah have mercy on him) that he did not see any harm in not giving any part of the dowry before going to the wife.
