كِتَابُ الطَّلَاقِ
Book of Divorce
بَابُ مَا جَاءَ فِي طَلَاقِ السَّكْرَانِ وَمَنْ لَمْ يَرَهُ وَمَنْ أَجَازَهُ
Chapter: What is reported regarding the divorce of the intoxicated, the absent, and those who permit it
Hadith Number: 1100
نا حزم بن ابي حزم، قال: سمعت الحسن، وساله رجل , فقال: يا ابا سعيد، رجل طلق امراته البارحة ثلاثا , وهو شارب؟ فقال:" يجلد ثمانين، وبرئت منه" .
Hasan al-Basri (may Allah have mercy on him) was asked about a man who, in a state of drunkenness at night, gave his wife three divorces. He replied: "He will be given the prescribed lashes, and the wife will be separated from him."

Hadith Number: 1101
نا هشيم، قال: انا يونس، عن الحسن، وابن سيرين ," انهما كانا يجيزان طلاق السكران ويريان ان يضرب الحد" .
Hasan and Ibn Sirin, may Allah have mercy on them, considered divorce given in a state of intoxication to be valid and believed in the implementation of the prescribed punishment.

Hadith Number: 1102
نا سفيان، عن ابن ابي نجيح، عن مجاهد، قال: " طلاق السكران جائز" .
Hazrat Mujahid (may Allah have mercy on him) said: The divorce of an intoxicated person is valid.

Hadith Number: 1103
نا هشيم، قال: انا مغيرة، عن إبراهيم، قال: " طلاق السكران جائز، ويضرب الحد لانه في عدوان" .
Ibrahim al-Nakha'i (may Allah have mercy on him) said: The divorce of an intoxicated person is valid and the prescribed punishment should be established upon him because this is an act of excess.

Hadith Number: 1104
نا هشيم، قال: انا إسماعيل بن ابي خالد، عن الشعبي ," انه كان يجيز طلاق السكران، وما اتى من حد في سكره اقيم عليه" .
Hazrat Aamir Sha'bi (may Allah have mercy on him) said: Divorce given in a state of intoxication is valid, and whoever becomes liable for a hadd punishment, the hadd will be established upon him.

نا هشيم، قال: انا حجاج، عن عطاء، انه كان يقول ذلك ايضا.
Hazrat Ata (may Allah have mercy on him) also used to say the same.

نا نا عبد الله بن وهب، قال: اخبرني مخرمة بن بكير، عن عبيد الله بن مقسم، قال: سمعت سليمان بن يسار، يقول:" إن رجلا من آل البختري طلق امراته وهو سكران فضربه عمر الحد , واجاز عليه طلاقه" .
Sulaiman bin Yasar (may Allah have mercy on him) said: A man from the family of Bakhtari divorced his wife while intoxicated. Sayyiduna Umar (may Allah be pleased with him) imposed the prescribed punishment on him and enforced the divorce.

نا عبد العزيز بن محمد، قال: اخبرني عبد الرحمن بن حرملة، عن سعيد بن المسيب ," انه كان يرى طلاق السكران جائزا".
Hazrat Saeed bin Musayyib (may Allah have mercy on him) considered divorce given in a state of intoxication to be valid.
