كِتَابُ الطَّلَاقِ
Book of Divorce
بَابُ مَا جَاءَ فِي طَلَاقِ السَّكْرَانِ وَمَنْ لَمْ يَرَهُ وَمَنْ أَجَازَهُ
Chapter: What is reported regarding the divorce of the intoxicated, the absent, and those who permit it
Hadith Number: 1110
نا هشيم، قال: انا يحيى بن سعيد، عن عمر بن عبد العزيز ," انه اتي برجل طلق امراته وهو سكران، فاستحلفه بالله الذي لا إله إلا هو انه طلق وما يعقل، فحلف، فرد عليه امراته وضربه الحد" .
A man who had divorced his wife while intoxicated came to Sayyiduna Umar bin Abdul Aziz (may Allah have mercy on him). He made him swear an oath that if he had given the divorce while unconscious, then he returned his wife to him and imposed the prescribed punishment.

Hadith Number: 1111
نا هشيم قال: انا يحيى بن سعيد، عن القاسم بن محمد، انه قال كما قال عمر بن عبد العزيز.
Hazrat Qasim bin Muhammad (may Allah have mercy on him) also gave a fatwa in accordance with Hazrat Umar bin Abdul Aziz (may Allah have mercy on him).

Hadith Number: 1112
نا نا ابو معاوية، قال: نا ابن ابي ذئب، عن الزهري، عن ابان بن عثمان، عن عثمان رضي الله عنه , قال: " كل الطلاق جائز إلا طلاق النشوان وطلاق المجنون" .
Sayyiduna Uthman (may Allah be pleased with him) said: Every divorce is valid except the divorce of one who is intoxicated and the divorce of a madman.

Hadith Number: 1113
نا نا هشيم، قال: انا الاعمش، عن إبراهيم، عن عابس بن ربيعة النخعي , قال: سمعت عليا رضي الله عنه , يقول: " كل الطلاق جائز إلا طلاق المعتوه" .
Sayyiduna Ali (may Allah be pleased with him) said: Every divorce is valid except that of a mentally disabled (insane) person.

Hadith Number: 1114
نا هشيم، قال: انا اشعث بن سوار، قال انا عبد الرحمن بن عابس، عن ابيه، انه سمع عليا ، رضي الله عنه , يقول ذلك ايضا.
Abdur Rahman bin Abis narrates from his father that Sayyiduna Ali (may Allah be pleased with him) said this.

Hadith Number: 1115
نا نا سفيان، وابو عوانة، وابو عوانة، عن الاعمش، عن إبراهيم، عن عابس بن ربيعة، عن علي رضي الله عنه , قال: " كل الطلاق جائز إلا طلاق المعتوه" .
It is narrated from Hazrat Abis bin Rabee’ah that Sayyiduna Ali (may Allah be pleased with him) said: Every divorce is valid except that of an insane person.

Hadith Number: 1116
نا نا ابو شهاب، عن الاعمش، عن إبراهيم، عن عابس بن ربيعة، عن علي رضي الله عنه , قال: " من طلق فيجوز طلاقه إلا طلاق المعتوه" .
It is narrated from Sayyiduna Ali (may Allah be pleased with him) that whoever gives divorce, his divorce is valid except for the insane person.

Hadith Number: 1117
نا هشيم، قال: انا إسماعيل بن سالم، قال: سمعت الحكم بن عتيبة , قال: " من طلق في سكر من الله عز وجل فليس طلاقه بشيء، ومن طلق في سكر من الشيطان فطلاقه له لازم" .
Hazrat Hakam bin Utaybah (may Allah have mercy on him) said: The divorce of one who is intoxicated out of fear of Allah is invalid, and the divorce of one who is intoxicated by Satan is binding.

Hadith Number: 1118
نا ابو معاوية، قال: نا الحجاج، عن الحكم , قال:" كان يقول في طلاق المبرسم، والمحموم الذي يهذي , ونكاح الجن , ان طلاقهم ليس بشيء، وإن نكاح الجن ليس بشيء" .
Hazrat Hakam (may Allah have mercy on him) said: The marriage and divorce of a person suffering from bersem (unconsciousness), a person afflicted with fever who speaks deliriously, and those possessed by jinn have no validity.

Hadith Number: 1119
نا حفص بن غياث، عن عبيدة، عن إبراهيم , قال: " طلاق السكران جائز، والمبرسم لا يجوز" .
Ibrahim Nakha'i (may Allah have mercy on him) said: The divorce of a drunk person is valid, the divorce of a person afflicted with epilepsy is not valid.
