كِتَابُ الطَّلَاقِ
Book of Divorce
بَابُ مَا جَاءَ فِي طَلَاقِ الْمُكْرَهِ
Chapter: What is reported regarding the divorce of the coerced
Hadith Number: 1138
نا هشيم، قال: انا يونس، ومنصور، عن الحسن ," انه كان لا يرى طلاق المكره شيئا" .
Hasan al-Basri (may Allah have mercy on him) said: A divorce given under compulsion has no validity.

Hadith Number: 1139
نا ابو عوانة، عن قتادة، عن الحسن ," انه كان لا يرى طلاق المكره شيئا" .
It is narrated from Hasan al-Basri (may Allah have mercy on him) that he did not consider a divorce given under compulsion to be of any significance.

Hadith Number: 1140
نا خالد بن عبد الله، عن يونس، عن الحسن ," انه كان يهاب طلاق المستكره" .
Hasan al-Basri, may Allah have mercy on him, was afraid to pronounce divorce on a detestable person.

Hadith Number: 1141
نا هشيم، قال: انا عبد الملك، وحجاج، عن عطاء ," انه كان لا يرى طلاق المكره شيئا" .
Hazrat Ata (may Allah have mercy on him) said: There is no validity to a divorce given under compulsion.

Hadith Number: 1142
نا هشيم، قال: انا عبد الملك، عن عطاء، قال: " الشرك اعظم من الطلاق" .
Hazrat Ata (may Allah have mercy on him) said: Shirk is a greater sin than divorce.

Hadith Number: 1143
نا نا هشيم، قال: انا عبيد الله بن طلحة الخزاعي، قال: حدثني ابو يزيد المديني، عن ابن عباس , انه قال: " ليس لمكره ولا لمضطهد طلاق" .
Sayyiduna Abdullah bin Abbas (may Allah be pleased with them both) said: Divorce does not take place in a state of compulsion and coercion.

Hadith Number: 1144
نا هشيم، قال: انا منصور، وعوف، عن الحسن، قال:" إن الله عز وجل تجاوز لهذه الامة عن النسيان، والخطا , وما اكرهوا عليه" .
Hasan al-Basri (may Allah have mercy on him) said: Allah Almighty has pardoned this Ummah for forgetfulness, mistakes, and compulsion.

Hadith Number: 1145
نا خالد بن عبد الله ، عن هشام ، عن الحسن ، عن النبي صلى الله عليه وسلم , قال:" إن الله عز وجل عفا لكم عن ثلاث: عن الخطا، والنسيان، وما استكرهتم عليه" .
The Messenger of Allah, peace and blessings be upon him, said: Allah Almighty has pardoned for you three things: mistake, forgetfulness, and what you are compelled to do.

Hadith Number: 1146
نا إسماعيل بن عياش ، قال: حدثني جعفر بن حيان العطاردي ، عن الحسن ، قال: سمعته يقول: قال رسول الله صلى الله عليه وسلم: " تجاوز الله عز وجل لابن آدم عما اخطا , وعما نسي، وعما اكره، وعما غلب عليه" .
The Messenger of Allah (peace and blessings be upon him) said: Allah Almighty has forgiven the son of Adam for his mistakes, forgetfulness, compulsion, and that over which he is overpowered.

Hadith Number: 1147
نا ابو شهاب، عن الاعمش، عن إبراهيم، قال: " طلاق السلطان واللصوص جائز" .
Ibrahim Nakha'i (may Allah have mercy on him) said: Divorce given under the force of a ruler or bandits is valid.
