كِتَابُ الطَّلَاقِ
Book of Divorce
بَابُ مَا جَاءَ فِيمَنْ بَدَأَ بِالْيَمِينِ فِي الطَّلَاقِ وَالْعَتَاقِ قَبْلَ الِاسْتِثْنَاءِ
Chapter on those who begin with an oath in divorce and emancipation before making an exception
Hadith Number: 1804
نا جرير، عن منصور، عن إبراهيم، قال: كان شريح، يقول: " متى بدا باليمين في الطلاق والعتاق قبل المثنوية فقد وقع عليه الطلاق والعتاق" .
Hazrat Shurayh (may Allah have mercy on him) said: "When, in the matters of divorce and freeing a slave, one gives precedence to divorce in an oath, then the divorce will take effect."

Hadith Number: 1805
نا جرير، عن منصور، قال: قال سعيد بن جبير: إن لم يحنث فلا يقع عليه.
Hazrat Sa'id bin Jubair (may Allah have mercy on him) said: "If the oath is not broken, the divorce will not take place."

Hadith Number: 1806
نا ابو معاوية، قال: نا الاعمش، عن إبراهيم، عن شريح، قال: " إذا بدا الرجل بالطلاق وقع حنث او لم يحنث" ، قال: وكان إبراهيم، يقول: وما يدري شريح.
Hazrat Shurayh (may Allah have mercy on him) said: "When a person begins a conversation with divorce, the divorce will take effect whether the oath is broken or not." And Ibrahim (may Allah have mercy on him) said: "What does Shurayh know about this matter?"

Hadith Number: 1807
نا هشيم، قال: انا مغيرة، عن إبراهيم، عن شريح، قال: " من بدا بالطلاق فلا استثناء عليه" .
Hazrat Shurayh (may Allah have mercy on him) said: "Whoever begins a conversation with divorce, there is no exception for him."
تخریج الحدیث:
Hadith Number: 1808
نا هشيم، قال: انا حصين، عن الشعبي، عن شريح، انه كان يقول: " من بدا بالطلاق لزمه الطلاق" .
Hazrat Shurayh (may Allah have mercy on him) said: "Whoever begins a conversation with divorce, divorce will become binding upon him."

Hadith Number: 1809
نا خالد بن عبد الله، عن مغيرة، عن إبراهيم، عن شريح، انه كان يقول: " إذا بدا الرجل بالطلاق لم يغن شرطه شيئا" .
Hazrat Shurayh (may Allah have mercy on him) said: "When a man begins a conversation with divorce, then his condition will be of no benefit."

Hadith Number: 1810
نا خالد، عن مغيرة، عن إبراهيم، في رجل قالت له امراته: بلغني انك تزوجت، فقال: " كل امراة له غيرك طالق" ، فاخبره بقول شريح بتقديم الطلاق وتاخيره.
Hazrat Shurayh (may Allah have mercy on him) said: A woman said to her husband, "I have heard that you have married another woman." And the husband said, "Every wife of mine except you is divorced."

Hadith Number: 1811
نا هشيم، عن سيار، عن عبد الرحمن بن تروان، قال: لقد ترك شريح في صدور الورعين فيها هاجسا.
Abdur Rahman bin Tharwan (may Allah have mercy on him) said: "Shurayh cast doubt into the hearts of the pious."

Hadith Number: 1812
نا حماد بن زيد، عن ليث، عن طاوس، في الرجل يقول: إن لم افعل كذا وكذا، فامراته طالق إن شاء الله، قال: " ثنياه في الطلاق والعتاق" .
Hazrat Tawus (may Allah have mercy on him) said: "If a person says, 'If I do not do such-and-such work, then my wife is divorced, insha'Allah,' then making an exception (by saying insha'Allah) is valid in the matters of divorce and freeing a slave."

Hadith Number: 1813
نا إسماعيل بن إبراهيم، قال: نا ليث، عن عطاء، وطاوس، ومجاهد، والنخعي، والزهري، انهم قالوا: " إذا قال الرجل لامراته، انت طالق إن لم تفعلي كذا وكذا، إن شاء الله فلم تفعل له ثنياه" .
Hazrat Ata, Hazrat Tawus, Hazrat Mujahid, Hazrat Nakha'i, and Hazrat Zuhri (may Allah have mercy on them) said: "If a husband says: 'If you do not do such-and-such, then you are divorced, insha'Allah,' and then the woman does not do that thing, then divorce will not take place."
