كِتَابُ الطَّلَاقِ
Book of Divorce
بَابُ مَنْ قَالَ: يُوقَفُ الْمُولِي عِنْدَ الْأَرْبَعَةِ الْأَشْهُرِ
Chapter on those who said: The one who makes an oath of abstinence is stopped at four months
Hadith Number: 1906
نا نا سفيان، عن ابي إسحاق الشيباني، عن الشعبي، عن عمرو بن سلمة، قال: قال علي رضي الله عنه: " إذا آلى الرجل من امراته فإنه يوقف حتى يفيء او يطلق" .
Sayyiduna Ali (may Allah be pleased with him) said: "When a man makes an oath of abstinence (ila) from his wife, he will be prevented (from doing so) until he either returns (to her) or divorces her."

نا سفيان، عن ليث، عن مجاهد، عن مروان، عن علي ، مثله.
A similar statement from Sayyiduna Ali (may Allah be pleased with him) is also narrated through Marwan.

نا نا هشيم، قال: انا ابو إسحاق، عن الشعبي، قال: انا عمرو بن سلمة الكندي،" انه شهد عليا رضي الله عنه " اوقف رجلا عند الاربعة الاشهر، إما ان يفيء، وإما ان يطلق" .
Amr bin Salamah Kindi (may Allah have mercy on him) said: "I saw Ali (may Allah be pleased with him) stop a man after four months, telling him either to take her back or to divorce her."

نا نا هشيم، قال: انا الشيباني، عن بكير بن الاخنس، عن مجاهد، عن عبد الرحمن بن ابي ليلى، قال: شهدت عليا رضي الله عنه، " اوقف رجلا عند الاربعة الاشهر بالرحبة، إما ان يفيء، وإما ان يطلق" .
Hazrat Abdur Rahman bin Abi Laila (may Allah have mercy on him) said: "I saw Ali (may Allah be pleased with him) in Al-Rahbah stopping a man at four months, that he should either return (to his wife) or divorce (her)."

Hadith Number: 1910
نا خالد بن عبد الله الشيباني، قال: اخبرني بكير، عن سعيد بن المسيب، عن علي رضي الله عنه، مثله.
Imam Sa'id bin al-Musayyib (may Allah have mercy on him) also narrated this same report from Sayyiduna Ali (may Allah be pleased with him).

نا نا هشيم، قال: نا عبد الحميد، عن نافع، عن ابن عمر ، انه قال في المؤلي عن امراته:" يوقف عند الاربعة الاشهر، فإما ان يفيء، وإما ان يطلق" .
Sayyiduna Ibn Umar (may Allah be pleased with them both) said: "The one who takes an oath of abstinence (mu'alla) is to be held for four months; then he must either return (to his wife) or divorce (her)."

نا نا عبد العزيز بن جعفر، عن ابيه، ان عليا رضي الله عنه، قال في الإيلاء:" يوقف عند الاربعة الاشهر، فإما ان يفيء، وإما ان يطلق" .

نا نا سفيان، عن ابي الزناد، عن القاسم بن محمد:" ان الرجل كان يولي من امراته، فيمكث اكثر من اربعة اشهر، وكانت عائشة رضي الله عنها لا ترى ذلك إيلاء" .
Qasim bin Muhammad (may Allah have mercy on him) said: "A man would take an oath of abstinence (ila) from his wife and leave her for more than four months, but Lady Aisha (may Allah be pleased with her) did not consider this to be ila."

Hadith Number: 1914
نا نا عبد العزيز، قال: اخبرني يحيى بن سعيد، عن عبد الرحمن بن القاسم، عن ابيه، ان عائشة رضي الله عنها" كانت لا ترى الإيلاء شيئا حتى يوقف" .
Sayyida Aisha (may Allah be pleased with her) said: "There is no ila unless it is enforced."

Hadith Number: 1915
نا سفيان، عن يحيى بن سعيد، عن سليمان بن يسار، قال:" كان تسعة عشر رجلا من اصحاب محمد صلى الله عليه وسلم يوقفون في الإيلاء" .
Sulaiman bin Yasar (may Allah have mercy on him) narrated: "Nineteen companions of the Prophet (peace be upon him) held the opinion of restraining in Ilaa."
