بَابُ الْأَسِيرِ فِي أَيْدِي الْعَدُوِّ وَالْعَمَلِ فِي مِيرَاثِهِ
Chapter on the captive in the hands of the enemy and dealing with his inheritance
Hadith Number: 2830
نا ابن عياش، عن عبد العزيز بن عبيد الله، عن الشعبي، في الاسير المسلم في ايدي العدو قال:" يرث ويورث ما كان على دينه" .
Hazrat Sha'bi (may Allah have mercy on him) said: A Muslim prisoner who is in the custody of the enemy—if he remains firm on his religion—then he becomes an heir and inheritance can also be taken from him.

Hadith Number: 2831
نا هشيم، قال: انا داود، عن الشعبي، ان شريحا، كان يورث الاسير، وكان يقول:" احوج ما يكون إلى نصيبه من الميراث إذا كان اسيرا في ايدي العدو، فإما ان يفادوه، وإما ان يعزلوه حتى يجيء منه ما جاء" .
Hazrat Shurayh (may Allah have mercy on him) said: A prisoner becomes an heir. Because he is in the possession of the enemy and is most in need of his share. Ransom should be given for him or his share should be set aside.
