Book of Preemption
ذكر خبر ثان يصرح بصحة ما ذكرنا معنى قوله صلى الله عليه وسلم الجار أحق بسقبه-
Second report confirming the meaning of“the neighbor has more right to his property”
Hadith Number: 5186
اخبرنا القطان بالرقة، قال: حدثنا نوح بن حبيب ، قال: حدثنا عبد الرزاق ، قال: اخبرنا معمر ، عن الزهري ، عن ابي سلمة ، عن جابر بن عبد الله ، قال:" قضى رسول الله صلى الله عليه وسلم في الشفعة في كل ما لم يقسم، فإذا وقعت الحدود وصرفت الطرق فلا شفعة" .
Sayyiduna Jabir bin Abdullah (may Allah be pleased with both of them) narrates: The Prophet Muhammad (peace and blessings be upon him) gave the verdict regarding pre-emption (shuf‘ah) that it applies to everything which has not been divided, but when boundaries have been set and the paths have become separate, then there is no pre-emption.
