The third is "Ghamoos," when a person knows that a certain thing did not happen, yet deliberately swears a false oath that it did happen, either to please someone, to have an excuse accepted, or to usurp someone's property. The sin of this oath is so great that its expiation cannot be made in this world.

Sayyiduna Abdullah bin Umar (may Allah be pleased with them) used to say: Whoever swears an oath by Allah and then says "InshaAllah" (if Allah wills), and then does not do the act upon which he swore, his oath will not be broken.

Imam Malik, may Allah have mercy on him, said: Saying "Insha Allah" means that it is said along with the oath and the conversation continues. If one swears an oath and then remains silent, and afterwards says "Insha Allah," it will not be of any benefit.

Imam Malik, may Allah have mercy on him, said: If a person says, "If I do this act, then I am a disbeliever or a polytheist," and then he does that act, there will be no expiation upon him, nor will he become a disbeliever or a polytheist unless he holds the belief of polytheism and disbelief in his heart. However, he will be sinful; he should repent and not say such a thing again.

It is narrated from Sayyiduna Abu Huraira (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "Whoever swears an oath regarding something, then finds something better than it, should pay the expiation for his oath and do what is better."

Imam Malik, may Allah have mercy on him, said: Whoever says, "I have taken a vow upon myself," and does not specify what the vow is for, then the expiation for an oath is obligatory upon him.

He said: A person swore an oath saying, "By Allah, I will not eat this food, I will not wear this garment, and I will not enter the house." Then he did all these things, so only one expiation will be required. Its example is like a man saying to his wife, "You are divorced if I make you wear this garment, and if I permit you to go to the mosque." This will be considered as one statement. Now, if any one of these matters occurs, the divorce will take place. Then if the second matter occurs, divorce will not take place again.

Imam Malik, may Allah have mercy on him, said: It is permissible for a woman to make a vow without her husband's permission, as long as the vow does not cause any harm to the husband. If it does cause harm to the husband, he can prevent her from fulfilling it. However, the vow will remain obligatory upon the woman, and she should fulfill it when the opportunity arises.

Malik said: The practice among us regarding a woman's vow is that it is permissible without her husband's permission, and it becomes obligatory upon her. It is established if it pertains to her own body, and if it does not harm her husband. But if it does harm her husband, then he has the right to prevent her from it, and it remains obligatory upon her until she fulfills it.

Sayyiduna Abdullah bin Umar (may Allah be pleased with them both) used to say: Whoever swears an oath and then firmly maintains it, then breaks the oath, must free a slave or feed ten needy people. And whoever swears an oath and does not firmly maintain it, then breaks the oath, must feed ten needy people, giving each needy person one mudd of wheat. If he is not able to do so, then he must fast for three days.
