172 Subchapter: First endowment (waqf) charity in Islam, and its conditions: keeping the principal, forbidding sale, gift, or inheritance, and dedicating its benefit to the poor, relatives, freeing slaves, in Allah’s cause, travelers, and the weak
Hadith Number: 2483
It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that Sayyiduna Umar (may Allah be pleased with him) received some land and gardens in Khaybar, so he came to the service of the Noble Prophet (peace and blessings be upon him) to consult about it. He says: I have never received any wealth as valuable as the land I have acquired in Khaybar, so what do you command me regarding it? The Prophet (peace and blessings be upon him) said: "If you wish, keep the original ownership of the land with yourself and give its benefits and produce as charity." Sayyiduna Ibn Umar (may Allah be pleased with them both) says that Sayyiduna Umar (may Allah be pleased with him) gave that land as charity on the condition that its original (property) would neither be sold, nor gifted, nor inherited. He gave its benefits and produce as charity for the poor relatives, for freeing slaves, for the warriors in the path of Allah, for travelers, and for the weak. Whoever supervises it may eat from it in a reasonable manner and may feed his friends as well, but he should not be one who accumulates wealth (i.e., does not make it his own property). Ibn Awn says: I narrated this tradition to Muhammad, and he said: "ghayra muta’ammil mālan"—he should not be desirous and hopeful of wealth. Ibn Awn says: A person who reads the book narrated to me the words "ghayra muta’aththil mālan"—he should not be one who accumulates wealth. Imam Abu Bakr (may Allah have mercy on him) says that Abdullah Umar al-Umari narrated from Imam Nafi’ from Sayyiduna Ibn Umar (may Allah be pleased with them both) that the first endowment (waqf) in Islam was the charity of Sayyiduna Umar ibn Khattab (may Allah be pleased with him). Sayyiduna Umar (may Allah be pleased with him) submitted to the Messenger of Allah (peace and blessings be upon him) that indeed I have some wealth and I wish to give it in charity. So the Messenger of Allah (peace and blessings be upon him) said: "Keep its original in your ownership and give its fruits and produce in charity." Thus, Sayyiduna Umar (may Allah be pleased with him) wrote this endowment deed.

173 Subchapter: Permissibility of endowing for an uncountable number of people
The Imam has narrated the report of the previous chapter from multiple narrators. Al-San‘ani did not mention the word "traveler" in it and narrated the words "ghayra mutamawwil fihi" (he should not accumulate wealth in it). Muhammad bin ‘Abd al-A‘la narrated the words "ghayra muta’aththil" (he should not gather wealth, nor make it as his own property), and did not mention the reading of the book by Ibn ‘Awn.

And in the way of Allah, and for freeing slaves, and for the guest, without stipulating a specific share for the way of Allah, nor a share for freeing slaves, nor a share for the guest from it, and permitting the condition of the endower for the caretaker of it to eat from it in a customary manner, without specifying a set amount of food by a known measure or a known weight, and his stipulation to feed his friend if he has one, without mentioning the amount that he feeds the friend from it.

Sayyiduna Ibn Umar (may Allah be pleased with them both) narrates that Sayyiduna Umar (may Allah be pleased with him) acquired a piece of land in Khaybar, so he went to the Prophet Muhammad (peace be upon him) to seek advice. Then he narrated the complete hadith, and Sayyiduna Ibn Umar (may Allah be pleased with them both) says that Sayyiduna Umar (may Allah be pleased with him) gave that land as charity on the condition that its original property would neither be sold, nor bought, nor gifted, nor inherited. It was dedicated for the poor, relatives, those striving in the way of Allah, guests, and travelers. There is no sin upon its caretaker if he eats from it in a reasonable manner or feeds a friend from it, but he should not accumulate wealth from it (i.e., not make it his own property).

And making its fruits dedicated to those among the poor and relatives whom he described, and those mentioned with them, along with the evidence that the endowment, if the endower does not remove it from his possession, is valid and permissible. For if the endowment were not valid except by the endower removing it from his possession, the Chosen One, peace and blessings be upon him, would have ordered Umar, when he commanded this charity, to remove it from his possession. And the Prophet, peace and blessings be upon him, had ordered—in the narration of Yazid ibn Zuray‘—to keep its principal, saying: "If you wish, keep its principal and give it in charity." And if the endowment were not completed except by the endower removing it from his possession, the Chosen One, peace and blessings be upon him, would not have ordered al-Faruq to keep its principal.

It is narrated from Sayyiduna Ibn Umar (may Allah be pleased with them both) that Sayyiduna Umar (may Allah be pleased with him) consulted the Noble Prophet (peace and blessings be upon him) regarding his charity. The Prophet said: "Keep its original property (in your ownership) as waqf and give its yield as charity." So Abdullah says that Sayyiduna Umar (may Allah be pleased with him) dedicated that land as waqf for the needy who ask, the deprived, travelers, those striving in the way of Allah, for freeing slaves, and for the poor. And (as a supervisor) he used to eat from it and feed his friends and loved ones from it, but he never made it his personal property.

Hazrat Ahnaf bin Qais (may Allah have mercy on him) narrated a lengthy hadith regarding the martyrdom of Sayyiduna Uthman (may Allah be pleased with him). And he said: Suddenly, Sayyiduna Ali, Zubair, Talha, and Sa’d bin Abi Waqqas (may Allah be pleased with them) arrived while I was still standing in that state. Then Sayyiduna Uthman (may Allah be pleased with him) came and said: I ask you by Allah, besides whom there is no true deity, do you know that the Messenger of Allah (peace and blessings be upon him) said:“Who will purchase the well of Rumah (and dedicate it for the Muslims)? Allah will forgive him.”So I bought that well for such and such amount. Then I came to your service and submitted that I have bought that well for such and such price. The Prophet (peace and blessings be upon him) said:“Make this well a public utility for the Muslims (so that people may drink from it and give others to drink), and you will have its reward.”All those present said: Yes, certainly it is so.

Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that I heard the Messenger of Allah (peace and blessings be upon him) say: "By the One in Whose hand is my soul, whatever I leave behind, my heirs will not distribute it. Whatever wealth we (the Prophets) leave behind is charity." This charity was first in the possession of Sayyiduna Ali (may Allah be pleased with him). Then Sayyiduna Abbas (may Allah be pleased with him) gained control over it. There was a long dispute between these two gentlemen regarding it. (Then both wanted to distribute it), but Sayyiduna Umar (may Allah be pleased with him) refused to distribute this wealth between the two. Until Sayyiduna Abbas (may Allah be pleased with him) withdrew from this wealth and Sayyiduna Ali (may Allah be pleased with him) gained control over it. Then it remained under the management of Sayyiduna Ali's son, Sayyiduna Hasan (may Allah be pleased with him). Then it came under the supervision of Sayyiduna Husayn bin Ali (may Allah be pleased with them both). After them, it was managed by their sons, Ali bin Husayn and Hasan bin Husayn, who managed it alternately. Then it came under the supervision of Hazrat Zaid bin Hasan. Whereas it is the true charity of the Messenger of Allah (peace and blessings be upon him).
