Condemnation of Theft
Hadith Number: 586
141- مالك عن ثور بن زيد الديلي عن ابى الغيث سالم مولى ابن مطيع عن ابى هريرة قال: خرجنا مع رسول الله صلى الله عليه وسلم عام خيبر فلم نغنم ذهبا ولا ورقا إلا الاموال المتاع والثياب، قال: فاهدى رجل من بني الضبب يقال له: رفاعة بن زيد لرسول الله صلى الله عليه وسلم غلاما اسود يقال له مدعم، فوجه رسول الله صلى الله عليه وسلم إلى وادي القرى، حتى إذا كنا بوادي القرى بينما مدعم يحط رحل رسول الله صلى الله عليه وسلم إذ جاءه سهم عائر فاصابه فقتله، فقال الناس: هنيئا له الجنة، فقال رسول الله صلى الله عليه وسلم ”كلا والذي نفسي بيده إن الشملة التى اخذ يوم خيبر من المغانم لم تصبها المقاسم لتشتعل عليه نارا.“ فلما سمع الناس ذلك جاء رجل بشراك او شراكين على رسول الله صلى الله عليه وسلم، فقال رسول الله صلى الله عليه وسلم: ”شراك او شراكان من نار.“ تم الجزء الاول بعون الله وتاييده.
It is narrated from Sayyiduna Abu Hurairah (may Allah be pleased with him) that in the year of Khaybar, we set out with the Messenger of Allah (peace and blessings be upon him) (for jihad), and among the spoils of war, we found neither gold nor silver except for property (lands), goods, and clothes. A man from the tribe of Banu Dubab, Rifa‘ah bin Zayd, gave the Messenger of Allah (peace and blessings be upon him) a black slave as a gift, who was called Mid‘am. The Messenger of Allah (peace and blessings be upon him) sent him towards Wadi al-Qura. When we reached Wadi al-Qura, we saw that Mid‘am was unloading the saddle from the mount of the Messenger of Allah (peace and blessings be upon him), when suddenly an unidentified arrow came and struck him, and he died. The people said:“Congratulations to him for Paradise!”But the Messenger of Allah (peace and blessings be upon him) said:“Never! By the One in Whose hand is my soul! The cloak he concealed (by stealing) on the day of Khaybar before the distribution of the spoils has become a fire wrapping him.”When the people heard this, a man came to the Messenger of Allah (peace and blessings be upon him) with a strap or two straps, and the Messenger of Allah (peace and blessings be upon him) said:“A strap or two straps are from the fire.”With the help and support of Allah, the first part is completed.
تخریج الحدیث: «141- متفق عليه، الموطأ (رواية يحييٰ بن يحييٰ 459/2 ح 1012، ك 21 ب 13 ح 25 وعنده: سهم عائر) التمهيد 3/2، الاستذكار:949، و أخرجه البخاري (6707) و مسلم (115) من حديث مالك به.»
قال الشيخ زبير على زئي:سنده صحيح
Consuming Unlawful Wealth Is Forbidden
Hadith Number: 587
140- مالك عن العلاء بن عبد الرحمن عن معبد بن كعب السلمي عن اخيه عبد الله بن كعب بن مالك عن ابى امامة ان رسول الله صلى الله عليه وسلم قال: ”من اقتطع حق مسلم بيمينه حرم الله عليه الجنة واوجب له النار.“ قالوا: وإن كان شيئا يسيرا يا رسول الله؟! قال: ”وإن كان قضيبا من اراك.“ قالها ثلاثا._x005F_x000D_كمل حديث العلاء وهو تسعة احاديث.
It is narrated from Sayyiduna Abu Umamah (may Allah be pleased with him) that the Messenger of Allah (peace and blessings of Allah be upon him) said: "Whoever seizes the right of a Muslim by (false) oath, Allah has made Paradise forbidden for that person and made (the fire of) Hell obligatory upon him." The people asked: O Messenger of Allah! Even if it is a small thing? He (peace and blessings of Allah be upon him) said: Even if it is a twig of the «اراك» (miswak tree). He (peace and blessings of Allah be upon him) said this three times. The ahadith narrated by 'Ala (bin Abdur Rahman) are now complete, and these are nine (9) ahadith.
تخریج الحدیث: «140- الموطأ (رواية يحييٰ بن يحييٰ 727/2 ح 1473، ك 36 ب 8 ح 11) التمهيد 263/20، الاستذكار: 1396، و أخرجه أحمد (456/5 ح 24723) من حديث مالك، ومسلم (137/218)، (ترقيم دارالسلام: 353) من حديث العلاء به.»
قال الشيخ زبير على زئي:سنده صحيح
Prohibition of Images
Hadith Number: 588
125- وبه: ان رافع بن إسحاق مولى الشفاء اخبره، قال: دخلت انا وعبد الله بن ابى طلحة على ابى سعيد الخدري نعوده، فقال لنا ابو سعيد: اخبرنا رسول الله صلى الله عليه وسلم: ”ان الملائكة لا تدخل بيتا فيه تماثيل او صور“، شك إسحاق لا يدري ايتهما قال ابو سعيد الخدري.
It is narrated from Rafi' bin Ishaq that he and Abdullah bin Abi Talhah went to visit Sayyiduna Abu Sa'id al-Khudri (may Allah be pleased with him) during his illness, and he told them that the Messenger of Allah (peace and blessings be upon him) informed them: "Indeed, the angels (of mercy) do not enter a house in which there are statues or pictures." Ishaq was in doubt; he was not certain which of these words Abu Sa'id al-Khudri (may Allah be pleased with him) had said.
تخریج الحدیث: «125- الموطأ (رواية يحييٰ بن يحييٰ 965/2، 966 ح 1867، ك 54 ب 3 ح 6) التمهيد 300/1، الاستذكار: 1803، و أخرجه الترمذي (2805) من حديث مالك به وقال: ”حسن صحيح“ وصححه ابن حبان (1486)»

Hadith Number: 589
260- مالك عن نافع عن القاسم بن محمد عن عائشة ام المؤمنين انها اشترت نمرقة فيها تصاوير. فلما رآها رسول الله صلى الله عليه وسلم قام على الباب فلم يدخل، فعرفت فى وجهه الكراهية وقالت: يا رسول الله، اتوب إلى الله ورسوله، فماذا اذنبت؟ فقال رسول الله صلى الله عليه وسلم: ”ما بال هذه النمرقة؟“ قالت: اشتريتها لك تقعد عليها وتتوسدها. فقال رسول الله صلى الله عليه وسلم: ”إن اصحاب هذه الصور يوم القيامة يعذبون بها، يقال لهم: احيوا ما خلقتم“، ثم قال: إن البيت الذى فيه الصور لا تدخله الملائكة.“
It is narrated from Umm al-Mu'minin Sayyida Aisha Siddiqa (may Allah be pleased with her) that she bought a small cushion-like blanket which had pictures on it. When the Messenger of Allah (peace and blessings be upon him) saw it, he stood at the door and did not enter inside. I saw signs of displeasure on the face of the Messenger of Allah (peace and blessings be upon him) and said: O Messenger of Allah! I turn to Allah and His Messenger, what mistake have I made? The Messenger of Allah (peace and blessings be upon him) said: "What is this cushion (small pillow)?" I said: I bought it for you so that you may sit on it and lean against it. The Messenger of Allah (peace and blessings be upon him) said: "Those who make these pictures will be punished on the Day of Resurrection; it will be said to them: Bring to life what you have created." Then the Messenger of Allah (peace and blessings be upon him) said: "The angels (of mercy) do not enter a house in which there are pictures."
تخریج الحدیث: «260- متفق عليه، الموطأ (رواية يحييٰ بن يحييٰ 966/2، 967 ح 1869، ك 54 ب 3 ح 8) التمهيد 50/16،51، الاستذكار:1805، أخرجه البخاري (2105) و مسلم (2107/96) من حديث مالك به، وفي رواية يحيي بن يحيي: ”وتوسدها“.»

Statement on the prohibition of Mut'ah
Hadith Number: 590
64- مالك عن ابن شهاب عن عبد الله والحسن ابني محمد بن على عن ابيهما عن على بن ابى طالب رضي الله عنه: ان رسول الله صلى الله عليه وسلم نهى عن متعة النساء يوم خيبر وعن اكل لحوم الحمر الإنسية.
It is narrated from Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) that indeed the Messenger of Allah (peace and blessings of Allah be upon him) on the day of the Battle of Khaybar forbade temporary marriage with women and the meat of donkeys.
تخریج الحدیث: «64- متفق عليه، الموطأ (رواية يحييٰ بن يحييٰ 542/2 ح 1178، ك 28 ب 18 ح 41) التمهيد 94/10، الاستذكار: 1098، و أخرجه البخاري (4216، 5523) ومسلم (1407/29) من حديث مالك به.»
قال الشيخ زبير على زئي:صحيح
Spitting towards the qiblah is forbidden
Hadith Number: 591
205- وبه: ان رسول الله صلى الله عليه وسلم راى بصاقا فى جدار القبلة فحكه: ثم اقبل على الناس فقال: ”إذا كان احدكم يصلي فلا يبصق قبل وجهه فإن الله قبل وجهه إذا صلى.“
And with the same chain of narration (from Sayyiduna Ibn Umar, may Allah be pleased with them both), it is narrated that the Messenger of Allah, peace and blessings be upon him, saw spit on the wall facing the qiblah, so he scraped it off (and cleaned it), then turned towards the people and said: "When any one of you prays, he should not spit in front of himself, because when he prays, Allah is in front of him."
تخریج الحدیث: «205- متفق عليه، الموطأ (رواية يحييٰ بن يحييٰ 194/1 ح 458، ك 14 ب 3 ح 4) التمهيد 154/14، الاستذكار:427، و أخرجه البخاري (406) ومسلم (547) من حديث مالك به.»
قال الشيخ زبير على زئي:سنده صحيح
Hadith Number: 592
460- وبه: ان رسول الله صلى الله عليه وسلم راى فى جدار القبلة بصاقا او مخاطا او نخامة فحكه.
And with the same chain of narration (from Sayyidah Aisha, may Allah be pleased with her), it is narrated that the Messenger of Allah, peace and blessings be upon him, saw spit or phlegm on the wall facing the qiblah, so he scraped it off (and cleaned it).
تخریج الحدیث: «460- متفق عليه، الموطأ (رواية يحييٰي بن يحييٰي 195/1 ح 459، ك 14 ب 3 ح 5) التمهيد 136/22، الاستذكار: 428، و أخرجه البخاري (407) ومسلم (549) من حديث مالك به.»
قال الشيخ زبير على زئي:سنده صحيح
The price of a dog is forbidden
Hadith Number: 593
57- مالك عن ابن شهاب عن ابى بكر بن عبد الرحمن بن الحارث بن هشام عن ابى مسعود الانصاري ان رسول الله صلى الله عليه وسلم نهى عن ثمن الكلب ومهر البغي وحلوان الكاهن.
It is narrated from Sayyiduna Abu Mas'ud Uqbah bin Amr Al-Ansari (may Allah be pleased with him) that indeed the Messenger of Allah (peace and blessings be upon him) forbade the price of a dog, the earnings of a prostitute, and the gift of a soothsayer or astrologer.
تخریج الحدیث: «57- متفق عليه، الموطأ (رواية يحييٰ بن يحييٰ 656/2 ح 1400، ك 31 بب 29 ح 68) التمهيد 397/8، الاستذكار: 1321، و أخرجه البخاري (2237) ومسلم (1567) من حديث مالك به.»
قال الشيخ زبير على زئي:صحيح
Earnings of a prostitute and soothsayer are forbidden
Hadith Number: 594
57- مالك عن ابن شهاب عن ابى بكر بن عبد الرحمن بن الحارث بن هشام عن ابى مسعود الانصاري ان رسول الله صلى الله عليه وسلم نهى عن ثمن الكلب ومهر البغي وحلوان الكاهن.
It is narrated from Sayyiduna Abu Mas'ud Uqbah bin Amr Al-Ansari (may Allah be pleased with him) that indeed the Messenger of Allah (peace and blessings be upon him) forbade the price of a dog, the earnings of a prostitute, and the gift of a soothsayer or astrologer.
تخریج الحدیث: «57- الموطأ (رواية يحييٰ بن يحييٰ 656/2 ح 1400، ك 31 بب 29 ح 68) التمهيد 397/8، الاستذكار: 1321، و أخرجه البخاري (2237) ومسلم (1567) من حديث مالك به»
قال الشيخ زبير على زئي:صحيح
Keeping dogs without purpose is not allowed
Hadith Number: 595
256- وبه: ان رسول الله صلى الله عليه وسلم قال: ”من اقتنى كلبا ليس بكلب صيد ولا كلب ماشية نقص من اجره كل يوم قيراطان.“
And with the same chain of narration (from Sayyiduna Ibn Umar, may Allah be pleased with them both), it is narrated that the Messenger of Allah, peace and blessings be upon him, said: "Whoever keeps a dog other than a dog for hunting or for guarding livestock, then two qirats are deducted from his reward (good deeds) every day."
تخریج الحدیث: «256- متفق عليه، الموطأ (رواية يحييٰ بن يحييٰ 969/2 ح 1874، ك 54 ب 5 ح 13، نحو المعنيٰ) التمهيد 217/14، الاستذكار:1810، أخرجه البخاري (5482) و مسلم (1574/50) من حديث مالك به.»
