If a Man Publicly Divorces His Wife and Then Takes Her Back Without Her Knowledge and She Marries Another, What Is the Ruling?

٢٠٠٠٣ - حدثنا ابو بكر قال: نا محمد بن بشر قال: (نا) (١) إسماعيل قال: سمعت الحكم بن (عتيبة) (٢) يذكر عن ابي كنف انه طلق امراته ثم راجعها ولم يعلمها الرجعة فتزوجت فركب في ذلك إلى عمر فقال: ارجع، إن وجدتها لم (ياتها) (٣) زوجها الذي نكحت فهي امراتك، فرجع (فلم) (٤) يجدها اتت زوجها فقبضها (٥).

(٢) في [جـ]: (عتبة)، وفي [أ، ط]: (عيينة)، وفي [ب]: (عنية)، وسقط من: [س].
(٣) في [س، هـ]: (تأتها)، وفي [أ، ب، جـ، ط]: (تأت)؛ وفي [ز]: (يأت).
(٤) في [س]: (ولم).
(٥) منقطع؛ الحكم لم يدرك عمر.
Hazrat Hakam bin Utaybah (may Allah have mercy on him) narrates that Abu Kanaf (may Allah be pleased with him) divorced his wife and then took her back, but did not inform her of the reconciliation. Then his wife got married (to someone else). Abu Kanaf (may Allah be pleased with him) asked Hazrat Umar (may Allah be pleased with him) about this matter. Hazrat Umar (may Allah be pleased with him) said to him: "Go to your wife, and if her (new) husband has not yet been intimate with her, then she is your wife." He went and saw that her husband had not yet been intimate with her. Therefore, Abu Kanaf (may Allah be pleased with him) took his wife back.
