باب: هل يوصي الرجل من ماله بأكثر من الثلث
Chapter: Can a man bequeath more than a third of his wealth?
Hadith Number: 359
انا ابو عتاب مسلم بن عطاء القرشي , ان رجلا توفي فاوصى في قرابته بشيء , فاستقلته القرابة , فقالوا لي: لو زدتهم، وكنت انا الوصي، فقلت: لا استطيع ان ازيدهم على ما امر لهم، فقالوا: فهل لك ان تسال الحسن, قلت: نعم، فذهبت مع حميد الطويل إلى الحسن فساله حميد عن ذلك وانا اسمع، فقال:" اراه قد سمى لهم شيئا انتهوا إلى ما سمى لهم" .
Muslim bin Ata (may Allah have mercy on him) narrates that a man made a bequest for his relatives, but the relatives considered it little, so they said: "Increase their share." I said: "I cannot increase their share." Then they said: "Ask Hasan Basri (may Allah have mercy on him)." When he was asked, he said: "What he has specified is sufficient."
