Book of Marriage
باب الرجل يتزوج المرأة فيدخل عليها ومعها نساء فوقع على امرأة منهن
Chapter: A man marries a woman, enters upon her, and there are other women with her, and he has intercourse with one of them
Hadith Number: 1012
نا هشيم، انا مغيرة، عن إبراهيم، انه سئل عن رجل، تزوج جارية، فدخل عليها ومعها جوار، فتناول واحدة , فقالت: لست بامراتك. فخلى عنها، ثم تناول اخرى , فقالت: لست بامراتك. فخلى عنها، ثم تناول اخرى , فقالت: لست بامراتك. فقال: اتدافعينني؟ فوقع بها، فنظر فإذا هي ليست بامراته، فقال إبراهيم:" لها الصداق، ويدرا عنه الحد لجهالته" .
It is narrated from Ibrahim (may Allah have mercy on him) that a man married a slave woman and she had other slave women with her. Whenever he touched one of them, she said: "I am not your wife." This happened three times, then he had relations with her. When he saw, she was not his wife. Ibrahim (may Allah have mercy on him) said: "The dowry is obligatory for that woman, and the legal punishment is waived for the man because he did not know."
