١٦٧٠٨ - قال: وقال سفيان: لا يجوز لانه غير ولي.
قال: وقال سفيان: لا يجوز ؛ لانه غير ولي،
16708 - He said: Sufyan said: It is not permissible because he is not a guardian.

١٦٧٠٩ - وقال علي بن صالح: هو جائز لان عليا حين اجازه كان بمنزلة الولي.
وقال علي بن صالح:" هو جائز ؛ لان عليا حين اجازه كان بمنزلة الولي"
16709 - Ali ibn Salih said: It is permissible because when Ali permitted it, he was in the position of the guardian.

١٦٧١٠ - حدثنا ابن فضيل عن ابيه عن الحكم قال: كان علي إذا رفع إليه رجل تزوج امراة بغير ولي فدخل بها امضاه (١).
ريفرينس و تحكيم الحدیث:
(١) منقطع؛ الحكم لم يدرك عليًا.
حدثنا حدثنا ابن فضيل، عن ابيه، عن الحكم، قال:" كان علي إذا رفع إليه رجل تزوج امراة بغير ولي فدخل بها ؛ امضاه"
Hazrat Hakam states that a case came before Hazrat Ali (may Allah be pleased with him) regarding a person who married someone without the permission of a guardian and had consummated the marriage. Hazrat Ali (may Allah be pleased with him) declared this marriage valid.
