٢٢٢٨٤ - حدثنا ابو بكر قال: حدثنا عبد الله بن نمير عن عبد الله بن عطاء عن ابن (بريدة) (١) عن ابيه قال: جاءت امراة إلى النبي ﷺ فقالت: إني تصدقت على امي بجارية فماتت امي، وبقيت الجارية، فقال لها:"وجب اجرك ورجعت إليك في الميراث" (٢).

(٢) صحيح؛ أخرجه مسلم (١١٤٩)، وأحمد (٢٣٠٣٢).
Hazrat Ibn Buraidah (may Allah be pleased with him) narrates from his father that a woman came to the service of the Holy Prophet (peace and blessings be upon him) and said: I had given a slave woman in charity on behalf of my mother. My mother has passed away and the slave woman has remained with me. The Prophet (peace and blessings be upon him) said: Your reward has been completed and the slave woman has returned to you as inheritance.

٢٢٢٨٥ - حدثنا ابو بكر قال: حدثنا ابن علية عن ايوب عن حميد بن هلال ان رجلا منهم تصدق على امه بامة فكاتبتها ثم توفيت امه، فسال عمران بن حصين فقال: انت ترث امك، وإن شئت وجهتها في الوجه الذي كنت وجهتها فيه، قال حميد: فلقد رايتها يقال لها: (لبيبة) (١) (٢).
ريفرينس و تحكيم الحدیث:
(١) في [أ، هـ]: (لبنية).
(٢) رجاله ثقات، والصواب أن بين حميد وعمران أبا الدهماء قرفة بن بهين، وهو ثقة هكذا أخرجه مسدد كما في المطالب (١٥٣٥)، وانظر: مصنف عبد الرزاق (١٦٥٨٣).
It is narrated from Hazrat Humaid bin Hilal (may Allah have mercy on him) that a man gave his mother a slave girl as charity. His mother made that slave girl a mukataba (a slave with a contract for freedom), then she passed away, so the slave girl came back to him as inheritance. That man asked Hazrat Imran bin Husain (may Allah be pleased with him) about this matter. He (may Allah be pleased with him) said: "You will be the heir to your mother's estate, and if you wish to deal with her (the slave girl) as you did before, you may do so." Hazrat Humaid says that her name was Labeebah.

٢٢٢٨٦ - حدثنا ابو بكر قال: حدثنا عباد بن العوام عن عمر بن عامر عن قتادة عن سعيد بن المسيب في الرجل يتصدق بالصدقة ثم يرثها، قال: إذا ردها (إليه) (١) كتاب الله فلا باس بها.

Hazrat Saeed bin Al-Musayyib (may Allah have mercy on him) says regarding a person who gives something in charity and then it returns to him as inheritance: He says that if it returns to him according to the command of the Book of Allah, then there is no harm in it.

22287 - He said: And Qatadah said: Ibn Mas'ud used to say that (1).

٢٢٢٨٨ - حدثنا ابو بكر قال: حدثنا هشيم عن مغيرة عن إبراهيم انه كان يقول في الصدقة إذا ورثها (١): يجعلها في مثل الوجه الذي كانت فيه.

(١) زاد في [ز]: (قال).
Ibrahim (may Allah have mercy on him) said that if a person, after giving something in charity, becomes its owner again through inheritance, then he should do with it as he did before.

It is narrated in a similar manner from Ibrahim al-Taymi, may Allah have mercy on him.

٢٢٢٩٠ - حدثنا ابو بكر قال: حدثنا (هشيم) (١) عن حصين عن الشعبي عن شريح انه كان لا يرى باسا ان ياكلها.

Hazrat Shurayh (may Allah have mercy on him) did not consider it objectionable for it to be eaten.

٢٢٢٩١ - حدثنا ابو بكر قال: حدثنا هشيم عن يونس عن الحسن انه كان لا يرى باسا ان ياكلها.
Hasan (may Allah have mercy on him) did not consider there to be any harm in eating it.

٢٢٢٩٢ - حدثنا ابو بكر قال: حدثنا هشيم عن سيار عن الشعبي قال: كل فإن الله لم يكن ليطعمك حراما.
Hazrat Sha'bi (may Allah have mercy on him) said: Eat it, Allah Almighty has not made its consumption unlawful for you.

٢٢٢٩٣ - حدثنا ابو بكر قال: حدثنا هشيم عن داود عن عامر عن مسروق قال: ما رد عليك سهام الفرائض فهو لك حلال.
Hazrat Masrooq (may Allah have mercy on him) says that whatever comes to you as a share in inheritance, eating it is lawful for you.
