٢٢٧٩٩ - [حدثنا ابو بكر قال: حدثنا (هشيم) (١) عن منصور عن الحسن (٢) في مضارب دفع المال إلى غيره (قال: لا) (٣) ضمان عليه، هو امين] (٤).

Hazrat Hasan (may Allah be pleased with him) says that if the mudarib gives the wealth (to someone other than the intended person), then he will be held liable because he is a trustee.

٢٢٨٠٠ - حدثنا ابو بكر قال: حدثنا عباد بن العوام عن حجاج عن عثمان بن اخي شريح (عن شريح) (١) انه قال: إذا خالف في الوديعة والكراء فهو ضامن.

Hazrat Shurayh (may Allah have mercy on him) says that if there is a violation of (the agreed conditions) in a trust or rental, then he will be held liable.

٢٢٨٠١ - حدثنا ابو بكر قال: حدثنا ابن ابي زائدة عن داود عن الشعبي في مضارب قال له صاحب المال: لا تجاوز مكان كذا وكذا قال: (هو) (١) (ضامن) (٢) إن جاوزه.

Hazrat Sha’bi (may Allah have mercy on him) says that if the owner of the wealth tells the mudarib not to go beyond such-and-such place, and if he still goes, then he will be held liable.

٢٢٨٠٢ - حدثنا ابو بكر قال: حدثنا علي بن مسهر عن داود عن الشعبي بنحوه.
It is narrated in a similar manner from Hazrat Sha'bi, may Allah have mercy on him.

٢٢٨٠٣ - حدثنا ابو بكر قال: حدثنا ابن ابي زائدة عن اشعث عن ابن سيرين قال: لا (تشترط) (١) على الضارب شيئا، فإني اخاف ان (يخالف) (٢) فيفسد عليك وعلى نفسه.

Hazrat Ibn Sirin (may Allah have mercy on him) said: Do not impose any condition on the mudarib, because I fear that if he opposes it, its harm will fall upon him and upon you.

٢٢٨٠٤ - حدثنا ابو بكر قال: حدثنا عبد الاعلى عن معمر عن الزهري انه سئل عن رجل دفع إليه ماله (١) مضاربة، (وقال) (٢): لا تخرج (من) (٣) المصر فخرج، قال: لا ضمان عليه.

A person asked Hazrat Zuhri (may Allah have mercy on him) that he was given money for Mudarabah, and he was told not to go outside the city, but he still went. He (Hazrat Zuhri) said, there is no liability upon him.

٢٢٨٠٥ - حدثنا ابو بكر قال: حدثنا عبد الوهاب الثقفي (عن خالد) (١) عن ابي قلابة في المضارب إذا اشترطوا عليه: (ان) (٢) لا يجاوز، (فجاوز) (٣)، فهو ضامن.

Hazrat Abu Qalabah says that if certain conditions are imposed on the mudarib that he should not exceed them, and if he still does so, then he will be held liable.

٢٢٨٠٦ - حدثنا ابو بكر قال: حدثنا عبد الوهاب عن ايوب عن إياس بن معاوية قال: هو ضامن.
Hazrat Iyas (may Allah have mercy on him) says that he will be the guarantor.

٢٢٨٠٧ - حدثنا ابو بكر قال: حدثنا ابن ابي زائدة عن عبد الملك بن (ابي) (١) سليمان عن عطاء قال: إن نهاه ان يخرج (فخرج) (٢) فهو ضامن.

Hazrat Ata (may Allah have mercy on him) says that if someone is forbidden from leaving the city and he still goes out, then he will be held liable.

٢٢٨٠٨ - حدثنا ابو بكر قال: حدثنا هشيم، عن حصين ومغيرة، عن إبراهيم قال: إذا خالف المستودع والمستعير والمستبضع فهو ضامن.
Hazrat Sha'bi (may Allah have mercy on him) says that if the trustee, the borrower, and the craftsman (the one who makes goods for trade) act against the agreed conditions, they will be held liable.
