Those Who Say: One Who Kills His Slave Will Not Be Killed in Retaliation

٢٩٣١٤ - حدثنا ابو بكر قال: حدثنا إسماعيل بن عياش عن إسحاق بن ابي فروة عن إبراهيم (بن) (١) عبد الله بن حنين عن ابيه عن علي قال: اتي النبي ﵇ (٢) برجل قتل عبده متعمدا فجلده رسول الله ﷺ (٣) مائة (جلدة) (٤) ونفاه سنة ومحا سهمه من المسلمين ولم يقده منه (٥).

(٥) ضعيف جدًّا؛ إسحاق بن أبي فروة متروك، أخرجه ابن ماجة (٢٦٦٤)، وأبو يعلى (٥٣١)، والدارقطني (٣/ ١٤٤)، والحارث (٥٢٤/ بغية)، وابن أبي عاصم في الديات (ص ٥٤)، والبيهقي (٨/ ٣٦).
Hazrat Abdullah bin Haneen narrates that Hazrat Ali (may Allah be pleased with him) said: A man was brought to the Noble Prophet (peace and blessings be upon him) who had deliberately killed his slave. So the Messenger of Allah (peace and blessings be upon him) ordered that he be given one hundred lashes and exiled for one year, and his share among the Muslims was abolished. The Prophet (peace and blessings be upon him) did not have him killed in retribution.

٢٩٣١٥ - حدثنا ابو بكر قال: حدثنا إسماعيل بن عياش عن إسحاق بن ابي ⦗١٧٨⦘ فروة عن عمرو بن شعيب عن ابيه عن جده عن النبي ﷺ (١) مثله (٢).
ريفرينس و تحكيم الحدیث:

(٢) ضعيف جدًّا؛ إسحاق متروك، أخرجه ابن ماجة (٢٦٦٤)، وعبد الرزاق (١٨١٣٩)، والطحاوي (٣/ ١٣٧)، والدارقطني (٣/ ١٤٣)، والبيهقي (٨/ ٣٦)، وابن الجوزي في التحقيق (١٧٦٠)، وابن عبد البر في الاستذكار (٨/ ١٧٧).
The mentioned action of the Holy Prophet Muhammad (peace and blessings be upon him) is also transmitted from Abdullah bin Amr through this chain of narration.

٢٩٣١٦ - حدثنا ابو بكر قال: حدثنا وكيع قال: (حدثنا شعبة) (١) عن مغيرة عن عامر قال: إذا قتل الرجل عبده عمدا لم يقتل به.

Hazrat Mughira narrates that Hazrat Aamir Sha'bi said: When a man intentionally kills his slave, he will not be killed in retaliation.

٢٩٣١٧ - حدثنا ابو بكر قال: حدثنا زيد بن الحباب عن ابن لهيعة عن خالد بن ابي عمران قال: سالت سالما والقاسم عن رجل قتل عبده، قالا: عقوبته ان يقتل ولكن لا يقتل به.
Hazrat Khalid bin Abu Imran says that I asked Hazrat Salim and Hazrat Qasim about a person who has killed his own slave? Both of them replied: His punishment is that he should be killed, but even then, he will not be killed in retaliation.

٢٩٣١٨ - حدثنا ابو بكر قال: حدثنا حفص عن حجاج عن عمرو بن شعيب ان ابا بكر وعمر كانا يقولان: لا يقتل المولى بعبده، ولكن يضرب ويطال حبسه ويحرم سهمه (١).

(١) منقطع؛ عمرو بن شعيب لم يدرك أبا بكر ولا عمر.
Hazrat Amr bin Shu'aib narrates that Hazrat Abu Bakr and Hazrat Umar used to say: The master will not be killed in retaliation for his slave, but he will be beaten, and he will be imprisoned for a long time, and he will be deprived of his share.
