٣٠١٥٠ - حدثنا ابو بكر قال: حدثنا عبد الاعلى عن سعيد عن ثمامة ان انس بن مالك كان إذا زنى مملوكه ضربه الحد (١).
ريفرينس و تحكيم الحدیث:
(١) رجاله ثقات، إنما يروى سعيد عادة عن قتادة عن أنس، ويروى عن سعيد عن قتادة عن ثمامة والأثر أخرجه البيهقي (٨/ ٢٤٥).
Hazrat Thumama narrates that when the slave of Hazrat Anas bin Malik (may Allah be pleased with him) committed adultery, he would enforce the prescribed punishment (hadd) upon him.

٣٠١٥١ - حدثنا ابو بكر قال: حدثنا سفيان بن عيينة عن الزهري عن عبيد الله عن ابي هريرة وزيد بن خالد وشبل قالوا: كنا عند النبي ﷺ فساله رجل عن الامة تزني قبل ان تحصن قال:"اجلدوها، فإن زنت فاجلدوها" قال في الثالثة او في الرابعة:"فبيعوها ولو بضفير" (١).

(١) صحيح؛ وهم ابن عيينة في ذكر شبل، أخرجه أحمد (١٧٠٤٣)، وابن ماجه (٢٥٦٥)، والنسائي في الكبرى (٧٢٦٠)، والشافعي في السنن (٥٤٠)، والحميدي (٨١٢)، وابن قانع ١/ ٣٤٥، والطبراني (٥٢٠٣)، والبيهقي ٨/ ٢٢٤، وابن أبي عاصم في الآحاد (١١٣)، وأصله عند البخاري (٢٥٥٥).
Hazrat Abu Huraira, Hazrat Shibl, and Hazrat Zaid bin Khalid narrate that we were with the Holy Prophet (peace and blessings be upon him) when a man asked him about a slave woman who commits adultery before being married. The Holy Prophet (peace and blessings be upon him) said: Flog her. Then if she commits adultery again, flog her. On the third or fourth time, the Holy Prophet (peace and blessings be upon him) said: Then sell her, even if it is for a rope made of hair.

٣٠١٥٢ - حدثنا ابو بكر قال: حدثنا ابو الاحوص عن عبد الاعلى عن ابي جميلة عن علي قال: اخبر النبي ﷺ بامة لهم فجرت، فارسلني إليها فقال:"اذهب، فاقم عليها الحد"، فانطلقت فوجدتها لم تجف من دمائها، فقال."افرغت؟" فقلت: وجدتها لم تجف من دمائها، فقال:"إذا جفت من دمائها (فاجلدها) (١)"، ثم قال رسول الله ﷺ:" (و) (٢) اقيموا الحدود على ما ملكت ايمانكم" (٣).

(٣) ضعيف؛ لضعف عبد الأعلى، أخرجه أحمد (٦٧٩)، وعبد اللَّه (١١٣٨)، والنسائي في الكبرى (٧٢٦٧)، والبيهقي (٨/ ٢٤٥)، وعبد الرزاق (١٣٦٠١)، والبزار (٧٦٢)، وأبو يعلى (٣٢٠)، وأبو داود (٤٤٧٣)، والدارقطني (٣/ ١٥٨)، والطيالسي (١٤٦)، وأصله في مسلم (١٧٠٥)، وأحمد (١٣٤١)، والترمذي (١٤٤١).
Hazrat Ali (may Allah be pleased with him) narrates that news reached the Noble Prophet (peace and blessings be upon him) regarding a slave girl belonging to some people, that she had committed a sin. So the Prophet (peace and blessings be upon him) sent me to her and said: "Go and establish the prescribed punishment on her." So I went and found her in such a state that her blood had not yet dried. The Prophet (peace and blessings be upon him) asked: "Have you finished?" I replied: "I found her in such a state that her blood had not yet dried!" The Prophet (peace and blessings be upon him) said: "When her blood dries, then flog her." Then the Messenger of Allah (peace and blessings be upon him) instructed: "Establish the prescribed punishments on those under your authority."

٣٠١٥٣ - حدثنا ابو بكر قال: حدثنا ابو معاوية عن الاعمش عن إبراهيم عن همام عن عمرو بن شرحبيل قال: جاء معقل المزني إلى عبد الله فقال: جاريتي زنت ⦗٣٧٦⦘ (فاجلدها؟) (١) قال: فقال عبد الله: اجلدها خمسين، (فقال: عادت) (٢)، فقال: اجلدها (٣).

(١) في [أ، ب، جـ، ط، ك، م]: (فأجلدوها).
(٢) سقط من: [ط].
(٣) صحيح.
Hazrat Amr bin Shurahbil narrates that Hazrat Ma'qil Muzani came to Hazrat Abdullah bin Mas'ud and said, "My slave-girl has committed adultery, so have her flogged!" Upon this, Hazrat Abdullah bin Mas'ud said, "Flog her with fifty lashes." He asked, "What if she commits adultery again?" He replied, "Flog her."

٣٠١٥٤ - حدثنا ابو بكر قال: حدثنا ابن عيينة عن عمرو عن الحسن بن محمد ابن علي ان فاطمة حدت جارية لها (١).

(١) منقطع؛ الحسن لم يدرك فاطمة.
Hazrat Hasan bin Muhammad bin Ali (may Allah be pleased with him) narrates that Hazrat Fatimah enforced the prescribed punishment (hadd) on her maidservant.

٣٠١٥٥ - حدثنا ابو بكر قال: حدثنا ابن عيينة عن ابي الزناد عن خارجة بن زيد عن زيد انه حد جارية له (١).

Hazrat Kharijah bin Zaid narrates that Hazrat Zaid enforced the prescribed punishment (hadd) upon his slave woman.

٣٠١٥٦ - حدثنا ابو بكر قال: حدثنا ابن علية عن خالد عن ابي قلابة ان ابا المهلب كان يجلد امته إذا فجرت في مجلس قومه.
Hazrat Abu Qalabah narrates that when the slave girl of Hazrat Abu al-Muhallab committed a bad deed, he would flog her in the assembly of his people.

٣٠١٥٧ - حدثنا ابو بكر قال: حدثنا جرير عن مغيرة عن فضيل عن إبراهيم قال: كانوا يرسلون إلى خدمهم إذا زنين (يجلدونهن) (١) في المجالس.

Ibrahim narrates that when the servants of the Companions committed adultery, they would call them and flog them in gatherings.

٣٠١٥٨ - حدثنا ابو بكر قال: حدثنا عبد الوهاب الثقفي عن ايوب عن نافع عن ابن عمر انه كان يضرب امته إذا فجرت (١).

(١) صحيح.
Hazrat Nafi' narrates that Hazrat Ibn Umar (may Allah be pleased with them) used to beat his slave-girl when she committed adultery.

٣٠١٥٩ - حدثنا ابو بكر قال: حدثنا عباد بن العوام عن اشعث عن ابيه قال: شهدت ابا برزة ضرب امة (له فجرت) (١) قال: وعليها ملحفة قد جللت ⦗٣٧٧⦘ (بها) (٢) قال: وعنده طائفة من الناس (ثم قرا) (٣): ﴿وليشهد عذابهما طائفة من المؤمنين﴾ (٤) [النور: ٢].

Hazrat Ash'ath's father narrates that I was present with Hazrat Abu Barzah. He struck his slave-girl who had committed a sinful act. The narrator says that the slave-girl was wrapped in a sheet and there was a group of people with him. He recited this verse: Translation: "And a group of the believers should witness their punishment."
