Sayyiduna Abu Sa'id Khudri (may Allah be pleased with him) narrates: A man came to the Prophet (peace and blessings be upon him) with his daughter and said, "My daughter is refusing to get married." The Prophet (peace and blessings be upon him) said, "Obey your father's command. Do you know what right a husband has over his wife? If there were a boil on the husband's nose from which pus and matter were oozing, and the woman licked it with her tongue, even then she would not have fulfilled the husband's right." The woman said, "By the One Who has sent you (peace and blessings be upon him) with the truth, I will not get married." The Prophet (peace and blessings be upon him) said, "Marry (the girls) with their consent."

Simak bin Harb narrates: A man came to Sayyiduna Ali (may Allah be pleased with him) and said: "There is a girl, I am her guardian, and she has married without my permission." So Sayyiduna Ali (may Allah be pleased with him) said: "Regarding what this girl has done, our opinion is that if she has married someone of equal status (kufu’), then we will let it stand; but if she has married someone who is not her equal, then we will give you (the guardian) the choice (to let it stand or annul it)."

Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) said: "A virgin girl should not be married until her permission is sought, and a previously married woman has authority over herself, as long as she does not incline towards displeasure. If she inclines towards displeasure and her guardian inclines towards consent, then this case will be presented before the ruler of the time." Ishaq says: I asked Isa: Is the last part of the narration transmitted from the Noble Prophet (peace and blessings be upon him)? He replied: "I do not know, but the narration is as such."

Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) said: "A previously married woman (widow or divorcee) should not be married until her consent is sought, and a virgin should not be married until her permission is taken, and her permission is her silence."

Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) said: "A previously married woman (widow or divorcee) has more right over her own affair, and permission should be sought from a virgin girl; her permission is her silence." Sa'id bin Salamah has corroborated this from Salih bin Kaysan. Ma'mar has narrated something different in its chain from both of them; he omitted the mention of one person from the chain. Similarly, Ma'mar has also narrated something different in the wording of this narration and has transmitted it in other words. However, he made a mistake in this, because every narrator who has transmitted it from Abdullah bin Fadl, and every narrator who has transmitted it from Abdullah bin Fadl along with Nafi' bin Jubayr, all of them have narrated it differently from Ma'mar. And the agreement of all these narrators on narrating it differently from Ma'mar is evidence that Ma'mar made a mistake in this matter. And Allah knows best.

Sayyiduna Ibn Abbas (may Allah be pleased with them) narrates: The Noble Prophet (peace and blessings be upon him) said: "A previously married woman has more right over herself than her guardian, and a virgin girl should be asked permission regarding herself; her permission is her silence."

Abdullah bin Raja narrated this same narration (the aforementioned hadith) through his chain of transmission.

Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) said: "The guardian has no authority regarding a previously married woman, and the consent of a virgin will be sought; her silence will be considered her approval."

Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) said: "The guardian has no authority over a previously married woman, and the consent of a virgin will be sought; her silence is her consent." Mu'ammar has transmitted it in the same way. The narration that has passed before this is more correct in terms of chain and text, because the narrator named Salih did not hear it from Nafi' bin Jubayr; he heard it from Abdullah bin Fadl. Ibn Ishaq and Sa'id bin Salamah agree in transmitting this from Salih. I heard Shaykh Abu Bakr Nishapuri saying: "In my view, Mu'ammar has erred in this matter."

Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) said: "The consent of a virgin girl regarding herself will be sought, and her silence will be considered her approval." Abu Dawood Tayalisi has transmitted it with his chain in the same manner.
