Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) said: "A previously married woman has more right over herself than her guardian, and the consent of a virgin girl should be sought; her permission is her silence."

Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) said:“A previously married woman has more right over herself than her guardian, and a virgin girl—her father will seek her consent regarding her (marriage).”The narrator named Amr has added these words:“Her permission is her silence.”This narration is also transmitted through some other chains of transmission.

This narration is also transmitted with another chain, however, all of its narrators have reported the word "al-thayyib".

Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) said:“A previously married woman has more right over herself than her guardian, and the consent of a virgin girl should be sought; if she remains silent, then that is her consent.”

Sayyiduna Ibn Abbas (may Allah be pleased with them both) narrates: The Noble Prophet (peace and blessings be upon him) said:“A previously married woman has more right over herself than her guardian, and the consent of a virgin girl should be sought; her permission is her silence.”These are the words of the narrator named Ibn Sinan, and both of these differ from the narration transmitted by Fadl bin Musa from Ibn Mahdi. The Shaykh says:“Here, there is a possibility that the term ‘virgin girl’ used in this hadith refers to a virgin orphan girl; and Allah knows best. The reason is that we have already mentioned in the narrations transmitted from Salih bin Kaysan and others who followed him, that the Noble Prophet (peace and blessings be upon him) said: ‘The consent of an orphan girl should be sought.’”As for the words transmitted by Ibn Uyaynah from Ziyad bin Sa’d:“The father will seek permission from the virgin girl,”to our knowledge, no other narrator has agreed with Ibn Uyaynah regarding these words. It is possible that he mentioned this narration from his memory and his tongue erred, and Allah knows best. From Abu Burdah, the same narration is transmitted from Sayyiduna Abu Musa Ash’ari (may Allah be pleased with him):“The consent of an orphan girl should be sought.”

Sayyiduna Abu Musa Ash'ari (may Allah be pleased with him) narrates: The Noble Prophet (peace and blessings be upon him) said: "The consent of an orphan girl regarding herself should be sought; if she remains silent, then she has given permission, but if she refuses, then she should not be forced." The narrator named Abu Qatan states: I asked Yunus, "Did you hear this narration from him? (The narrator is in doubt, perhaps these are the words) Did you hear it from Abu Burdah?" He replied, "Yes."

Abu Burdah narrates from his father (Sayyiduna Abu Musa Ash'ari, may Allah be pleased with him): The Noble Prophet (peace and blessings be upon him) said: "The consent of an orphan girl will be sought; if she remains silent, it will be considered as permission, and if she refuses, she will not be forced." Ibn Fudayl, Waki', Yahya bin Adam, Abdullah bin Dawud, Abu Qutaybah, and other narrators have transmitted it from Yunus bin Abu Ishaq.

Abu Burdah narrates from his father (Sayyiduna Abu Musa Ash'ari, may Allah be pleased with him): The Noble Prophet (peace and blessings be upon him) said: "The orphan girl will be consulted regarding herself, and her permission will be her silence."

Abu Burdah narrates from his father (Sayyiduna Abu Musa Ash'ari, may Allah be pleased with him) that the Prophet Muhammad (peace and blessings be upon him) said: "The consent of an orphan girl regarding herself will be sought, and if she agrees, then she will be married, and if she does not agree, then she will not be married."

Sayyiduna Abdullah bin Abbas (may Allah be pleased with them) narrates: The Noble Prophet (peace and blessings be upon him) said:“A previously married woman (widow or divorcee) has more right over her own affair than her guardian, and a virgin girl should be asked permission regarding herself, and her silence is her consent.”
