Chapter on paternal and maternal aunts
Hadith Number: 153
نا نا خالد بن عبد الله، وابو شهاب، عن يونس بن عبيد، عن الحسن، ان عمر بن الخطاب " اعطى العمة الثلثين، والخالة الثلث" .
Sayyiduna Umar bin Khattab (may Allah be pleased with him) gave two-thirds to the paternal aunt and one-third to the maternal aunt.

نا نا هشيم، قال: انا داود بن ابي هند، عن الشعبي، قال: انتهى إلى زياد عمة وخالة، فقال زياد:" انا اعلم الناس بقضاء عمر بن الخطاب فيها، جعل العمة بمنزلة الاب فجعل لها الثلثين، وجعل الخالة بمنزلة الام فجعل لها الثلث" .
It is narrated from ‘Amir Sha‘bi (may Allah have mercy on him) that a case concerning a paternal aunt and a maternal aunt was brought before Ziyad. Ziyad said:“I am most knowledgeable of the ruling of Sayyiduna ‘Umar ibn al-Khattab (may Allah be pleased with him); he gave the paternal aunt the status of the father and allotted her two-thirds, and he gave the maternal aunt the status of the mother and allotted her one-third.”

Hadith Number: 155
نا نا هشيم، قال: انا محمد بن سالم، قال: نا الشعبي، عن مسروق بن الاجدع، عن ابن مسعود ، انه قال: " العمة بمنزلة الاب، والخالة بمنزلة الام، وبنت الاخ بمنزلة الاخ، وكل ذي رحم بمنزلة رحمه التي تجره، إذا لم يكن وارث او فريضة" .
Masruq bin al-Ajda’ (may Allah have mercy on him) narrated from Sayyiduna Abdullah bin Mas’ud (may Allah be pleased with him) that he said:“The paternal aunt is in the place of the father, the maternal aunt is in the place of the mother, the brother’s daughter is in the place of the brother, and every relative is in the place of the one from whom they originate, when there is no other heir or prescribed heir.”

Hadith Number: 156
نا نا هشيم، قال: انا مغيرة، عن إبراهيم، ان مسروقا قضى في عمة وخالة،" فجعل العمة بمنزلة الاب، فجعل لها الثلثين، وجعل الخالة بمنزلة الام فجعل لها الثلث , قال إبراهيم: وكان عبد الله يقول ذلك" .
Masruq (may Allah have mercy on him) gave a ruling regarding the paternal aunt and the maternal aunt: he placed the paternal aunt in the position of the father and gave her two-thirds, and he placed the maternal aunt in the position of the mother and gave her one-third. Ibrahim (may Allah have mercy on him) said: Our master Abdullah bin Mas'ud (may Allah be pleased with him) also used to say the same.

Hadith Number: 157
نا نا هشيم، قال: انا مغيرة، عن إبراهيم، ان رجلا عرف اختا له سبيت في الجاهلية، فوجدها ومعها ابن لها، ولا يدري من ابوه، فاشتراهما ثم اعتقهما، واصاب الغلام مويلا ومات، فاتوا ابن مسعود فذكروا ذلك، فقال:" ائت امير المؤمنين عمر فاساله عن ذلك، ثم ارجع فاخبرني بما يقول لك. فاتى عمر، فذكر ذلك له، فقال: ما اراك عصبة ولا بذي فريضة. فرجع إلى ابن مسعود فاخبره، فانطلق ابن مسعود حتى دخل على عمر، فقال: كيف افتيت هذا الرجل؟ قال: لم اره عصبة ولا بذي فريضة. فقال عبد الله: هذا لم تورثه من قبل الرحم، ولا ورثته من قبل الولاء. قال: ما ترى؟ قال: اراه ذا رحم وولي نعمة، وارى ان تورثه. قال: فورثه" .
A man in the time of ignorance took hold of his sister, and with her was her son, whose father was unknown. He bought them and set them free. The boy became wealthy and died. The case was brought to Abdullah bin Mas'ud (may Allah be pleased with him). He said: "Go to the Commander of the Believers, Umar bin Khattab (may Allah be pleased with him)." They went, and Umar (may Allah be pleased with him) said: "You are neither an 'Asabah (agnate) nor among those entitled to a fixed share." Then they returned to Ibn Mas'ud (may Allah be pleased with him), and he said: "He is a guardian by kinship and favor; I make him the heir." Thus, Umar (may Allah be pleased with him) made him the heir.

Hadith Number: 158
Wabara, may Allah have mercy on him, narrated that Sayyiduna Umar, may Allah be pleased with him, and Sayyiduna Abdullah bin Mas'ud, may Allah be pleased with them both, gave the same verdict.

نا نا ابو معاوية، قال: نا الاعمش، عن إبراهيم، قال: " ورث عمر خالا المال كله، وكان خالا وكان مولى" .
Sayyiduna Umar bin Khattab (may Allah be pleased with him) gave the entire wealth to a maternal uncle, because he was both a maternal uncle and a slave.

Hadith Number: 160
نا نا هشيم، قال: انا ابو إسحاق الشيباني، قال: قيل للشعبي: إن ابا عبيدة بن عبد الله قضى في رجل ترك ابنته او اخته، فاعطاها المال كله. فقال الشعبي: قد كان من هو خير من ابي عبيدة يفعل ذلك، كان ابن مسعود يفعله .
It is narrated from Sha'bi (may Allah have mercy on him) that Abu Ubaidah bin Abdullah gave all the wealth to a man's daughter or sister. Sha'bi (may Allah have mercy on him) said: "People better than them also used to do this, such as Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him)."

نا خالد بن عبد الله، قال: انا الشيباني، عن الشعبي، قال: سالته عن ابنة الاخ، اولى او العمة، فقال: ابنة الاخ، اشهد على مسروق انه قال:" انزلوهن منازل آبائهن" .
Shu'bi (may Allah have mercy on him) said: I asked him, "Is the paternal uncle's daughter given precedence or the paternal aunt?" He said: "The paternal uncle's daughter." I bear witness that Masruq (may Allah have mercy on him) said: "Place them in the position of their father."

نا ابو عوانة، عن سليمان الشيباني، قال: قلت لعامر الشعبي: العمة احق بالميراث او ابنة الاخ؟ قال: وانت لا تعلم؟ ابنة الاخ، اشهد على مسروق انه قال:" انزلوهن منازل آبائهن" .
Shu'bi (may Allah have mercy on him) said: I asked 'Amir Shu'bi (may Allah have mercy on him), "Is the paternal aunt given precedence or the niece?" He replied: "Do you not know? The niece is given precedence." I bear witness that Masruq (may Allah have mercy on him) said: "Place them in the position of their father."
