كِتَابُ وِلَايَةِ الْعَصَبَةِ
Book of Agnatic Guardianship ('Asabah)
بَابٌ: هَلْ يُوصِي الرَّجُلُ مِنْ مَالِهِ بِأَكْثَرَ مِنَ الثُّلُثِ
Chapter: Can a man bequeath more than a third of his wealth?
Hadith Number: 340
نا هشيم، قال: انا إسماعيل بن ابي خالد، عن الشعبي " كان الخمس احب إليهم من الثلث , واما الثلث فهو منتهى الجامح" .
Ash-Sha'bi (may Allah have mercy on him) said: "One-fifth was more preferable than one-third, and one-third is for the one who exceeds the limit."

Hadith Number: 341
نا هشيم، قال: انا هشام، عن محمد بن سيرين، قال: قال شريح: " الثلث جهد وهو جائز" .
Shurayh (may Allah have mercy on him) said: "Bequeathing a third of one’s wealth is a great hardship, but it is permissible."

نا هشيم، قال: انا داود، عن عكرمة، قال: " الجنف في الوصية والإضرار فيها من الكبائر" .
Ikrimah (may Allah have mercy on him) said: "Excess and harm in a will are among the major sins."

نا نا خالد بن عبد الله، عن داود بن ابي هند، عن عكرمة، عن ابن عباس ، قال: " الجنف في الوصية والإضرار فيها من الكبائر" .
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: "Excess and deficiency in a will are among the major sins."

Hadith Number: 344
نا نا سفيان، عن داود، عن عكرمة، عن ابن عباس ، قال: " الحيف والجنف في الوصية، والإضرار فيها من الكبائر" .
Sayyiduna Ibn Abbas (may Allah be pleased with them both) said: "Committing injustice and excess in a will is among the major sins."

Hadith Number: 345
نا خالد بن عبد الله، قال: انا داود، عن عامر، قال: " من اوصى بوصية فلم يجر ولم يحف كان له من الاجر مثل ما اعطاها، وهو صحيح" .
‘Aamir (may Allah have mercy on him) said:“Whoever made a will and neither exceeded the limit nor committed injustice, he will have the reward for what he gave, as long as he was in good health.”

Hadith Number: 346
نا خالد، وهشيم، قالا جميعا نا داود، عن القاسم بن عمر، وقال هشيم ابن عمرو: عن ثمامة بن حزن , قال: قال لي: اوصى ابوك؟ قلت: لا، قال: " فمره فليوص، فإنه بلغنا انه من تمام ما نقص من الزكاة" .
Thumamah bin Hazn (may Allah have mercy on him) said: "My father did not make a will, so they said: Tell him to make a will, because it completes what is deficient from the zakat."

Hadith Number: 347
نا خالد، قال: انا عبيدة، عن إبراهيم" انه كره ان يوصي الرجل بالثلث والربع , ويقول: يدخل في ذلك المنخل ونحوه" .
Ibrahim (may Allah have mercy on him) disliked making a bequest of a third or a quarter and used to say:“This includes deductions and things like that.”

Hadith Number: 348
نا هشيم، وخالد بن عبد الله، قالا جميعا انا مغيرة، عن إبراهيم، انه كان يكره ان يوصي الرجل بمثل نصيب بعض الورثة وإن كان اقل من الثلث" .
Ibrahim (may Allah have mercy on him) disliked that a person should make a bequest equal to any of the heirs, even if it was less than one third.

Hadith Number: 349
نا خالد، قال: انا داود، عن عامر، في رجل له ثلاثة بنين فاوصى لرجل بمثل نصيب احد ولده قال:" يجعل رابعا" .
‘Amir (may Allah have mercy on him) said:“If a person has three sons and he makes a bequest to someone equal to one of his sons, then that person will be counted as a fourth.”
