كِتَابُ وِلَايَةِ الْعَصَبَةِ
Book of Agnatic Guardianship ('Asabah)
بَابُ الرَّجُلِ يُوصِي لِلرَّجُلِ فَيَمُوتُ الْمُوصَى لَهُ
Chapter: A man bequeaths to another man, but the legatee dies
Hadith Number: 367
نا هشيم، قال: انا منصور، ويونس، عن الحسن، في الرجل يوصي للرجل بالوصية فيموت الموصى له قبل الموصي , قال: " الوصية لولد الموصى له" . قال سعيد: لم يصنع شيئا.
Hasan al-Basri (may Allah have mercy on him) said: "If a person makes a bequest for someone, and that person dies before the one making the bequest, then the bequest goes to the children of the deceased." But Sa'id (may Allah have mercy on him) said: "Nothing happens in this way."

Hadith Number: 368
نا هشيم، عن مغيرة، عن إبراهيم، قال: " يرجع إلى ورثة الموصي" . قال سعيد: اصاب.
Ibrahim (may Allah have mercy on him) said: "In such a case, the bequest returns to the heirs of the one who made the bequest." Sa'id (may Allah have mercy on him) said: "This is the correct view."

Hadith Number: 369
نا هشيم، قال: انا مغيرة، عن ابي معشر، عن إبراهيم , في رجل اوصى بثلث ماله ثم افاد مالا قبل ان يموت من ميراث او غير ذلك , قال:" للذي اوصى له ثلث ماله وثلث ما افاد" .
Ibrahim (may Allah have mercy on him) said: "If a person makes a bequest of one-third of his wealth, then acquires more wealth before dying, whatever has increased will also be counted as part of the one-third."

Hadith Number: 370
نا هشيم، قال: انا يونس، عن الحسن، قال: " إذا اوصى الرجل بوصية ثم اوصى بوصية اخرى فوصيته الاخرى منهما" .
Hasan al-Basri, may Allah have mercy on him, said: "When someone makes one will, then makes another will, the last will shall be considered valid."

Hadith Number: 371
نا سفيان بن عمرو بن دينار، عن طاوس، وابى الشعثاء، وعطاء، قالوا: " يؤخذ بآخر الوصية" .
Tawoos, Abu Al-Sha'tha, and Ata (may Allah have mercy on them) said: "The last bequest is the one that is considered valid."

Hadith Number: 372
نا نا هشيم، قال: انا يونس، قال: نا الوليد بن ابي هشام، مولى قريش , قال: قرات وصية حفصة ام المؤمنين، فإذا هي قد اوصت باشياء وإذا في آخر وصيتها" ان اتى على ذواتي ما لم اغيرها" .
It was written in the will of Sayyidah Hafsah (may Allah be pleased with her): "If there has been no change in my will, then let it remain as it is."

Hadith Number: 373
نا نا يزيد بن هارون، عن ابن عون، عن نافع، قال: قالت ام المؤمنين عائشة : " يكتب الرجل في وصيته: إن حدث بي حدث الموت قبل ان اغير وصيتي هذه" .
Lady Aisha (may Allah be pleased with her) said: "A man should write in his will that if death comes to me before I make any change in my will."

Hadith Number: 374
نا هشيم، قال: انا يونس، عن الحسن , انه كان يقول: " إذا اوصى الرجل بوصية في مرضه , ثم برا , فلم يغير وصيته تلك حتى يموت بعد ذلك , جاز ما في وصيته" .
Hasan al-Basri (may Allah have mercy on him) said: "If someone made a will during illness, then recovered, and did not make any change in the will until he later died, then the will shall be executed."

Hadith Number: 375
نا هشيم، قال: انا يونس، عن الحسن، في رجل اوصى في مرضه:" إن حدث بي حدث , وهو ينوي في مرضه ذلك , فغلامه حر , فصح , قال: إن شاء باعه" .
Hasan al-Basri (may Allah have mercy on him) said: "If someone, during his illness, made a will that if death comes to him, his slave is free, then he recovers, he may sell that slave."

Hadith Number: 376
نا هشيم، قال: انا الشيباني، عن الشعبي، قال: " يرجع الرجل في وصيته كلها إلا العتق" .
Ash-Sha'bi (may Allah have mercy on him) said: "A man can revoke all of his bequests except for (the bequest of) emancipation (of a slave)."
