Book of Marriage
بَابُ مَا جَاءَ فِي اسْتِئْمَارِ الْبِكْرِ وَالثَّيِّبِ
Chapter: What is reported regarding seeking the consent of a virgin and a previously married woman
Hadith Number: 554
نا هشيم ، نا عمر بن ابي سلمة ، عن ابيه ، عن ابي هريرة , قال: قال رسول الله صلى الله عليه وسلم: " لا تنكح البكر حتى تستامر، ولا الثيب حتى تشاور". قالوا: يا رسول الله، إن البكر تستحيي. قال:" سكوتها رضاها" .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Messenger of Allah (peace and blessings be upon him) said: "A virgin girl should not be married without her permission, and a widow should be consulted. The silence of the virgin is her permission."

Hadith Number: 555
نا سفيان ، عن الزهري ، عن سعيد بن المسيب , قال: قال رسول الله صلى الله عليه وسلم: " تستامر اليتيمة في نفسها، وصمتها إقرارها" .
It is narrated from Sayyiduna Sa'id bin al-Musayyib (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: "The permission of the orphan girl is necessary for her marriage; her silence is her permission."

Hadith Number: 556
نا مالك بن انس ، عن عبد الله بن الفضل ، عن نافع بن جبير ، عن ابن عباس , قال: قال رسول الله صلى الله عليه وسلم: " الايم احق بنفسها من وليها، والبكر تستامر في نفسها، وإذنها صماتها" .
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them) that the Messenger of Allah (peace and blessings be upon him) said: "A widow is the owner of her own marriage, and the permission of a virgin is necessary; her silence is her permission."

Hadith Number: 557
نا نا جرير بن عبد الحميد، عن منصور، عن إبراهيم، عن عمر ، قال: " تستامر اليتيمة في نفسها، فإن سكتت فهو رضاها، وإن انكرت لم تنكح" .
Sayyiduna Umar bin Khattab (may Allah be pleased with him) said: "Permission should be sought from the orphan girl; if she remains silent, that is permission, and if she refuses, then the marriage should not be conducted."

Hadith Number: 558
نا نا هشيم، انا عبيدة، عن إبراهيم , قال: قال عمر بن الخطاب رضي الله عنه: " لا تنكح اليتيمة حتى تستامر، وسكوتها رضاها" .
Sayyiduna Umar bin Khattab (may Allah be pleased with him) said: "The marriage of an orphan girl should not take place without her permission; her silence is her consent."

Hadith Number: 559
ثنا ثنا هشيم، قال: انا مجالد، نا الشعبي، عن علي رضي الله عنه انه قال: " لا تزوج اليتيمة حتى تستامر، وسكوتها رضاها" .
Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) said: "The marriage of a female orphan should not be conducted without her permission; her silence is her consent."

Hadith Number: 560
نا هشيم، انا مغيرة، عن إبراهيم , قال: " لا تنكح اليتيمة حتى تستامر، فإن سكتت او بكت فهو رضاها، وإن كرهت لم تنكح" .
Ibrahim al-Nakha'i (may Allah have mercy on him) said: "Permission should be sought from the orphan girl before marriage; if she cries or remains silent, then this is consent, but if she refuses, then the marriage should not take place."

Hadith Number: 561
نا هشيم، انا اشعث بن سوار، عن ابن سيرين، عن شريح، انه كان يقول في اليتيمة:" لا تنكح حتى تستامر، فإن سكتت فهو رضاها، وإن كرهت وتعصت لم تنكح" .
Hazrat Shurayh (may Allah have mercy on him) said: "The marriage of an orphan girl will take place when she accepts with silence or consent; if she refuses, then it will not take place."

Hadith Number: 562
نا هشيم ، انا هشام بن ابي عبد الله ، عن يحيى بن ابي كثير ، عن المهاجر بن عكرمة المخزومي ، ان رسول الله صلى الله عليه وسلم كان إذا اراد ان يزوج إحدى بناته اتى الخدر، فقال:" إن فلانا يذكر كذا وكذا" .
The Messenger of Allah (peace be upon him) used to come to his daughters before their marriage and say: "So-and-so is talking about you."

Hadith Number: 563
نا هشيم، انا منصور، عن الحسن، انه كان يقول: " نكاح الوالد ابنته، بكرا كانت او ثيبا، جائز" .
Hasan al-Basri (may Allah have mercy on him) said: "It is permissible for a father to give his daughter in marriage, whether she is a virgin or a widow."
