Book of Marriage
بَابُ مَا جَاءَ فِي الرَّجُلِ يَزْنِي وَقَدْ تَزَوَّجَ امْرَأَةً وَلَمْ يَدْخُلْ بِهَا
Chapter: What is reported regarding a man committing adultery after marrying a woman but before consummation
Hadith Number: 856
نا نا ابو الاحوص، عن سماك بن حرب، عن حنش بن المعتمر، قال: اتي علي رضي الله عنه برجل قد اقر على نفسه بالزنا، فقال له: احصنت؟ قال: نعم. قال: إذا ترجم. فرفعه إلى الحبس، فلما كان بالعشي دعا به، وقص امره على الناس، فقال له رجل: إنه قد تزوج امراة ولم يدخل بها. ففرح علي بذلك، فضربه الحد، وفرق بينه وبين امراته، واعطاها نصف الصداق ، فيما يرى سماك.
A man came to Sayyiduna Ali (may Allah be pleased with him) and confessed to committing adultery. He asked him, "Are you a muhsan (i.e., married)?" He replied, "Yes." He said, "Then you will be stoned." But in the evening it was found out that he had only performed the marriage contract but had not consummated it, so he (Ali) became happy, administered the hadd punishment to him, separated him from his wife, and gave the wife half of the dowry.

Hadith Number: 857
نا نا ابو عوانة، عن سماك بن حرب، عن حنش، قال: جاء رجل إلى علي رضي الله عنه، فقال: إني قد زنيت. فقال:" إنك إذا ترجم إن كنت قد احصنت. قال: ملكت , او تزوجت , امراة ولم ابن بها. قال: فجلده مائة، وفرق بينهما، واعطاها طائفة من صداقها" .
A man came to Sayyiduna Ali (may Allah be pleased with him) and confessed to adultery. He said: "If you are a muhsan (married), you will be stoned." The man said: "I was married but had not consummated the marriage." So he (Ali) gave him one hundred lashes, separated him from his wife, and gave a portion of the dowry.

Hadith Number: 858
نا هشيم، قال: انا مغيرة، عن إبراهيم، انه كان يقول: " إذا زنت قبل ان يدخل بها، ضربت الحد، وفرق بينهما، ولا صداق لها" .
Ibrahim al-Nakha'i (may Allah have mercy on him) said: "If fornication is proven against a woman before consummation, then the hadd punishment will be carried out on her, the marriage will be annulled and separation will be enforced between the two, and the woman will not receive any dowry."

نا هشيم، انا يونس، عن الحسن، انه كان يقول ذلك.
Hasan al-Basri, may Allah have mercy on him, also said the same.

Hadith Number: 860
نا ابو عوانة، عن منصور، عن إبراهيم، في المراة تزني قبل ان يدخل بها , قال:" يفرق بينهما، ولا صداق لها" .
Ibrahim Nakha'i (may Allah have mercy on him) said: "If a woman commits adultery before consummation, the marriage should be annulled and the woman will have no dowry."

Hadith Number: 861
نا هشيم، قال: انا منصور، عن الحسن , انه كان يقول: " إذا زنى قبل ان يدخل بها، اقيم عليه الحد، وفرق بينهما، ولا صداق لها" .
Hasan al-Basri (may Allah have mercy on him) said: "If a man commits fornication before consummation, the hadd punishment will be carried out on him, the two will be separated, and the woman will not receive any dowry."

Hadith Number: 862
نا سفيان، عن يحيى بن سعيد، عن سعيد بن المسيب، في قوله عز وجل: " الزاني لا ينكح إلا زانية او مشركة سورة النور آية 3 , قال: نسختها وانكحوا الايامى منكم سورة النور آية 32 , فهي من ايامى المسلمين" .
Sayyiduna Sa'id bin al-Musayyib (may Allah have mercy on him) said in the explanation of the verse «الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً» [النور: 3] : "This verse was abrogated by «وَأَنْكِحُوا الْأَيَامَى» [النور: 32] , and they will be counted among the widowed women of the Muslims."

نا إسماعيل بن زكريا، عن يحيى بن سعيد، عن سعيد بن المسيب، مثله.
A similar narration is reported from Hazrat Sa'id bin al-Musayyib (may Allah have mercy on him).

Hadith Number: 864
نا هشيم، قال: انا محمد بن سالم، عن الشعبي، قال: " ايهما زنى جلد الحد، وهما على نكاحهما" ، قال هشيم: وهو القول.
Hazrat Sha'bi (may Allah have mercy on him) said: "Whichever of the two commits adultery, the prescribed punishment will be carried out on them, and they will remain upon the marriage." And Hushaym (may Allah have mercy on him) said: "This is the same opinion."

Hadith Number: 865
نا إسماعيل بن زكريا، عن حبيب بن ابي عمرة، عن سعيد، في قوله عز وجل: " الزاني لا ينكح إلا زانية او مشركة سورة النور آية 3 , قال: ليس هو بالنكاح، ولكنه الجماع" .
Hazrat Saeed bin Jubair (may Allah have mercy on him) said: "In the verse «الزَّانِي لَا يَنْكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً» , what is meant is not marriage but intercourse."
